<br />PUBLIC UTII.ITIES EA5EMENT AGREEMENT

<br />THIS PUBLIC UTILITIES EASEMEN7 AGREEMENT, hereinafter this Agreement, made this ��day of
<br />October 2010 between the DEPARTMENT OF AbMINISTRATIVE SERVICES, acting on behalf of the STATE OF
<br />NEBRASKA, hereinafter "GRANTOR" and GRANb I5LAND UTILITIES/CITY OF GRAND ISLAND, GRAND ISLAND,
<br />NEBRA5KA, a municipal corporation, hereinafter "GRANTEE",
<br />WITNE55ETH:
<br />Grantor, in consideration of the sum of.ONE DOLLAR ($1.00) and other valuable consideration, receipt
<br />of which is hereby acknowledged, th� undersigned owner daes hereby grant and convey to Grantee and to its
<br />successors and assigns, a public utilities easement with the rights of ingress and egress for the purpos� of
<br />constructing, recanstructing, replacing, repairin�, perpetually operating and maintaining electric, gas, water,
<br />sanitary sewer, storm sewer, drainage, telephane, cable N, communication systems, or other public utilities
<br />having an operating agreement with Grantee with all necessary appurtenances, thereto, over, upan, or under
<br />said public utilities easement on land described as follows:
<br />Tract 1
<br />Commencing at the nnrth�` corner of the Northeast Quarter (NE %), Section Five (5), Township
<br />Eleven (11) North, Range Nine (9) West; thence southerly along the easterly line of the said Nartheast
<br />Quarter (NE %) being an assumed bearing of 501° 40'39"E, a distance of one thousand eight hundred
<br />nine and eighty five hundredth (1,809.85) feet; thence 588�' z9'25"W, a di5tance of one hundred
<br />twenty seven and seventy two hundredth (127.72) feet to a point on the westerly ri�ht-af-way line of
<br />Broadwell Avenue being the ACTUAL Point of Beginning; thence continuing 589� 29 a distance
<br />of seven hundred sixty eight and forty one hundredths (768.41) feet; thence SO(� a di5tance
<br />of fifty five and ninety hundredths (55.90) feet; thence S05'� 28'00"E, a distance of three hundred thirty
<br />and seventeen hundredths (330.17) feet. The side lines of the abave described tract shall be
<br />prolonged or shortened as required to terminate on the boundary of Grantor's praperty.
