2010078�2 <br />of operation and callection, includang reasonable attorneys' fees, upon any indebtedness secured <br />hereby and in such order as the Authority may determaine; and except for such application, the <br />Authority shall not be liable to any p�rson for the collection or non-collection vf any r�nts, <br />income, issues or profits, for the failure to assert or enforce any of the foregoim.g rights, nor shall <br />the Authority be charged with any of the duties or obligations of a mortgagee in possession The <br />entering upon and taking possession of the Properiy, the collection o� such rents, income, issues <br />or p�rofits, th� doing of other acts herein authaarized, and the application thereof, shall not cure or <br />waive any Event of D�fault ar notice of d�fault h�reunder oar invalidate any act done pursuant to <br />such notice. <br />S, Upon an Event of Default hereunder the Authority shall also be entitled to the <br />appointment of a receiver by any court having ju.risdiction, without notice, to take possession and <br />protect the Premises described b�exein and aperate same and collect the Rents therefrom. <br />6. In the event of any casualty loss or damage to the Promises, or in the event of any <br />condemu�ation of the Fremises which requires restoration or repl,acement of th� partian of the <br />Premises so taken, ths insurancc proceeds or the Condemaation Awards will be paid to the <br />Authority. If the loan is not in monetary or nonmonetary Event of Default, and there aze <br />sufficient fi.�nds to repair or rebwild th� Improvements from the ���Y��ce proceeds or tk�e <br />Condemnation Award, the funds will be released by tlae Authority for the repairing or rebuilding <br />of the Premises. �n the event the funds aze insuf�cient to pay for the repairing or rebuilding of <br />the Premises, the Authority will pay down the debt unless the Crrantor provides sufficient funds <br />together with tlae insurance proceeds or Condemnation Award to pay for the repairing ar <br />rebuilding of the Premises. <br />7. The Gra�a.tar will keep the Im�rovements now existing or hereafter erected on the <br />Pz�emises insured a�ainst loss by fire and such other hazards, casualties, and contingencies, as <br />may be stipul,at�d by the Authority and other hazards as may be required from time to time by <br />the Authority, and all such insurance shall be evidenced by standard Fire �nd Extended �overage <br />Insurance Policy or Policies, in amaunts not less than necessary ta camply with the applicable <br />Coinsurance Clause percentage, but %n uo event shall the amounts of caverage be less than one <br />hundred percent (1.0U%) of the Replacement Values or nat less than the unpaid balance of the <br />Obligations secured by this Recapture Deed af Trust, whichever is the lesser, ara,d in default <br />thereof the Authority shall have the right to effect inswrance. Such policies shall be endorsed <br />with standazd Mortgagee clause with loss payable to the Authority, and shall be deposited with <br />the Autharity. Tf the Premises covered hereby, or a�n.y pazt thereof, shall be damaged by fire or <br />other hazard against which insuraace is held as her�in�bove provided, the aznaunts paid by any <br />insurance company in pursuancc of thhe cnntract af inswrance to the extent of the indebtedness <br />then remau�ing unpai�d, shall be paid to the Authority, and, at its option, may be applied to the <br />debt or released far the repairing or rebuilding af the Prcmises. In the event the incut-ance <br />proceeds aze insu�'i,cient to pay for the repair or rebuilding of the Premises, the Autharity will <br />pay down the debt unless the Grantor provides sufficient funds together with the insurance <br />proceeds to pay for the repair or rebwilcling of the Premises. <br />8. All Conde�nnatian Awards resulting from any eondemnation for public use of or <br />injury to any of said Premises are hereby assigned and shall be paid to the Authority, who may <br />Recapture Deed of Trust and Security Agraement <br />�+84Q-6755-9942.2 <br />
