<br />Deed of Trust. Ths words "Deed of Trust" mean this Deed of trust among Trustor, Lender, and 7rustee, end includes without
<br />limitation all assignment and security interest provisions relating to the Personal Property and Rents.
<br />Default. the ward "Default" means the Dafault set forth in this Deed of Trust in the section titled "Default".
<br />�nvironmental Laws. The words "Environmentel Laws" mean any and all stste, federal and local statutes, regulations and ordinances
<br />relating to the protection of human health or the environment, Including without limitation the Comprehensive �nvironmental
<br />Response, Compensation, and Liability Act of 1980, as amsnded, 42 U.S.C. Section 9601, et seq. ("CERCLA"1, the Supsrfund
<br />Amendments and Resuthorization Act of 1986, Pub. L. No. 99-499 1"SARA"1, the Hazardous Materials 7ranspnrtation Act, 49 U.S,C.
<br />Sectipn 1801, et seq., the Resource Conservation and Recavery Act, 42 U.S.C. Section 8901, et seq., or othsr applicable state or
<br />federal laws, rules, or regulstions adopted pursuant thereto.
<br />Event of Default. The words "Event of �efault" mean any of the events of default set forth in this Deed of 1"rust in the events of
<br />default sectian of this Deed of Trust.
<br />Guaranty. 7he word "Guaranty" means the guaranty from guarentor, endarser, surety, or accommodation party ta Lander, Including
<br />without limitation a guaranty of all or part of the Note.
<br />Hazardous Substances. The words "Hazardous Subatences" mean materials that, because of their quantity, concentration or
<br />physical, chemical or infectious characteristics, may cause or pose a present or potential hazard to human health or the environmant
<br />when improperly used, treated, stored, disposed of, generated, manufacturad, transported or otherwise handled. 7he wprds
<br />"Hazardous Substances" are used in their vary broadest sense end include without limitetion eny and all hazardnus or toxic
<br />substances, matariels or waste as defined by or listed under the Envirpnmental Laws. The term "Hazardous Substences" also
<br />includes, without limitation, petrplsum and petroleum by-products or any fraction thereof and esbestos.
<br />Improvements. The word "Improvementa" means all existing and future improvements, buildings, atructures, mobile homes affixed on
<br />the'Real Property, facilities, additions, replacements and other construction on the Real Property.
<br />Indebtedness. The word "Indebtedness" means all principal, interest, and other amounts, costs and expenses peyeble under the Note
<br />or Related Documents, together with all renewals af, extensions af, modificatipns of, consolidations nf and substitutions for the Note
<br />or Related Documents end any amounts expended or advanced by l.ender to discharge Trustor's obligations or expenses incurred by
<br />7rustee or Lender ta enforce Trustor's nbligations under this Deed of Trust, together with interest on such amounts as provided in this
<br />Deed of Trust.
<br />l.ender. 7he word "Lender" means Platte Valley State 8ank & 7'rust Company, its successors end assigns.
<br />Note. The word "Note" means the promissory note dated �ctober 18, 2010, Ifl thB OI'Igll7al principal amount Ofi
<br />$$0,3$�.26 from Trustor to Lender, together with all renewals qf, extensians of, modifications of, refinancings af, consolidations
<br />of, and substitutions for the promisspry note or agreement.
<br />{'ersonal Proparty. The words "Personel Property" mean all equipment, fixtures, and other articles of persanal property now or
<br />hereafter owned by Trustor, and now or hereafter attached ar effixed to the Fieal Praperty; together with all sccessions, parts, and
<br />edditians to, all replacements of, and all substitutiqns for, any of such prnperty; and together with all proceeds (including without
<br />limitation all insurance proceeds and refunds nf premiums) from any sele pr other disposition of tha Property.
<br />Property. The word "Property" means collectively the Real Property and the Personal Property.
<br />Real Property. 7he words "Real Property" mean tha real property, interests and rights, as further described in this Deed of 1"rust.
<br />Related bocuments. The words "Related Documents" mean all'promissory notes, credit agreements, loan agreements, environmentel
<br />agreements, guaranties, security agreements, mortgages, deeds of trust, sacurity deeds, collateral mortgages, and all other
<br />instruments, agreaments and documents, whether npw or hereafter existing, executed in connection with the Indebtedness.
<br />Rents. 7he word "Rents" means all present and future rents, revenues, income, isaues, royalties, profits, and other benefits derived
<br />from the Prpperty.
