�oioo�s�� (b) Requisitions can be submitted rnanthly to the Authority by no later Chan the tenth (1 p"') day Qf each month. Each Requisition must be submitted for approval to the Auth�rity, together with the completed and executed documents listed in Exhibft D, each in fnrrn and substance reasonably satisfactory to the Authority (the "Draw Documents"). (c) The Authority shall submit a request for the Section 1602 Pragram k'unds to the Treasury in an amount equal to the approved amount of the current Requisition (not to exceed, in the aggregate, the amount of the Subaward) within five (5) Business Days of approval by the Authority of the Draw Documents. (d) The Owner shal] cooperate with the Authority in obtaining and providing any additianal documentation that may be required by the Treasury to apprave ths request for the Section 1602 Program �'unds. (e) The Authority will withhold ten percent (10%) of the Subaward as retainage. Such retainage shall be released with the final disbuxsement of the Subaward; provid�d the Owner has satisfactorily performed the described work in accordance with this Agreement, the Recapture Deed of Trust and the Program Requirernents have been met. (� The 4wner acknowledges and a�rees that no Subaward shall be disbursed after thc Expiration Datc; provided, however, that the Expiration Date may be extEnded at the sole discretipn of the Autharity. To request an extension of the Expiration Date, the pwn�r must sularnit to the Authority fnr their review and approval doeutnentatian (in form and substance acceptable to the Authority) reflecting that at least thirty percent (30%) of the total adjusted basis in Land and depreciable property that is reasonably expected to be a part of the Project has been paid or incurred by the Qwner by December 31, 2010. All Requisitions must be submitted to the Authority at least ten (10) Business Days prior to the Expiration Date. (g) The Authority will not make any disbursements to the Owner for costs that: (i) are prohibited under the Program Requirernents; (ii) are not strictly in accordanc� with the terms af this Agreernent; (iii) are requested after the Expiration Date, unless such date is extended under Section 4.1(� hereof; (iv) were requested and/or incurred a�er termination of this A�,reement; or (v) were requested during the occurrence and continuation af an un.cured Event o:f Default. (h) The Authority is autha�zed to make modi�cations to the disbursement pracedures set forth herein and to establish additional requirements for disbursernent of the Subaward to the Owner as may be necessary or advisable for campliance with all the Program Requirements. ..9_ 4846-G923-1367.3
