For purposes of this filing, Grantor <br />is ihe record owner af the Property. The name and rnailing address of Grantor, as debtor, and the <br />narn� and mailin�; address of the Authority, as secured party, frarn which information concerning <br />this Financing Statement may be obtained, are set forth in the Preamble of this Security <br />Instrurnent. The Grantor shall immediately advise the Autharity in writing of any change in the <br />state af Grantor's arganization, or Grantor's exact legal na.me, or the places where the Personal <br />Property, or any part thereof, or the books and records concerning the Persanal Property, or any <br />part theareaf, are kept. <br />If any ot' the Property is deemed ta be personal property, this Security Instrument shall <br />also constitute a security agreeznent with respect to such persanal praperty executed by Grantor <br />as debtor in favor of the Authority as secured party. Upon the occurrence of an Event of Default, <br />the Authority may, in addition to and not in deragation of any ather rights and remedies of the <br />Authority under the Section 1642 Subaward Agreement dated as of even date herewith (the <br />"16p2 Agreement"), or any of the other documents evidencing or securing tlie 1602 Agreement <br />(collectively, the "16p2 Dacuments") each executed even date herewith or applicable law, in <br />accordance with Section 9-604 of the i..Tnifoxm Cornmercial Code, as applicable, or other such <br />provisions of the Uniform Commercial Code, elect (a) ta proceed under and have all the rights <br />and remedies of a secured party und�r Article 9 of the Uniform Commercial Cade and any other <br />applicable law, or (b) to proceed as to both the real property and the personal property in <br />accordance with the Authority's rights and remedies in respect af the real property encumbered <br />by this Security Instrument, whereupon at any t'oreclosure sale conducted pursuant to this <br />Security Instrument Trustee acting hereunder may of�'er the real and personal property together <br />as part of the same sale, with bids to be taken on the whole �f the real and personal property <br />rather than separately. <br />Grantor shall promptly natify the Autharity af the existence of any commercial tort claim <br />now or hereaftcr Existing against Grantor or the Property, and shall execute, acknowledge and <br />deliver a security agreement or other documentation as thc Autharity shall from time to tizne <br />require to acquire and perfect a valid and binding security interest in such commercial tort claizn, <br />TO HAVE AND TO HOLD the above-described Premises, with all rights, privileges, and <br />appurtenances thereto belonging, or in any way appertaining, unta said Trustee, forever, and <br />possession o� said Premises and praperty is now delivered unto the Trustee, in trust, however, for <br />the following purposes: <br />THIS RECAPTURE DEED O�' TRUST SHALL SECURE THE �'OLLOWING <br />OBLIGATIONS AND THE PERFORMANCE OF THE GR.ANTOR UNDER THE 1G02 <br />�GREEMENT (collectively, the "Obligatians"): <br />(a) Payrnent �f the abligations owed by Grantor to the Authority under the 1602 <br />Agreennent with respect to the subaward in the sum of $935,295 (the "Subaward") together with <br />all extensions, renewals, arnendments and madifications thercof; and <br />Re<apture Deed of Trust and 5ecurity Agreement <br />4834-8456-�838.2 <br />
