<br />Items_" At origination or at any timc during the term of the Laan, Lender may require that Community
<br />Association Ducs, Fees, and Assessments, if any, be eecrowed by Botrower, and such dues, fe�s and
<br />assessments shall be an Escrow Item. Bortawer shall promptly fuinish to Lender all notices of amounts ta
<br />be paid under this Section, Barrower shall pay Lcnder the Funds for Lscrow Items unless Lendet waives
<br />Sonower's obligation ta pay the Fuuds for any or all Escrow Itcrns. Lendcr may waive Sorrower's
<br />abligation ta pay to Lender Funds for any or all Escrow Items at any time_ Any such waiver rnay only bc
<br />in writing_ In the event of such waiver, Borrower shall pay directly, when and whcre payablc, the amaunts
<br />due for any Escrow Items for which payment of Funds has been waived by Lender and, if Lender reqnires,
<br />shall furnish to Lender receipts evidencing such paymcnt within such time period as. Lender may require_
<br />Sorrower'e obligation to m.ake such paymextts and to prc�vidc rcceipts shall for all purposes be deemed to
<br />be a covenant and agreement contained in this Security Instrutnent, as thc phrasc "covenant and agreement"
<br />is used in Section 9_ If Borrower is obligated to pay Eacrow Items diractly, pursuant to a waiver, and
<br />Borrower fails to pay the am�unt dne for an �scrow Item, Lender may exercise its rights under Section 9
<br />and pay sue� amount and Bonrower shall then be obligated under Seetion 9 to repay ta Lender any such
<br />amount. Lender may revoke the waiver as to any or all Escrow Items at any time by a notice given in
<br />accordance with Section 15 and, upon such revocation, Borrower shall pay to Lendcr all Funds, and in
<br />such amounts, that are then required under this Section 3.
<br />Lender may, at any time, cnllect and hold Fu�nds in an amount (a) sufficient to permit Lender ta apply
<br />the Funds at the time specified under R�SPA, and (b) not to excecd thc maximum amount a lender can
<br />require under RESPA. Lender shall estimate the amount of Funds due nn thc bssis af cuaxent data and
<br />reasonable estimates of expenditures af future Escrow Items or otherwise in accordance with Applicable
<br />Law.
<br />'I'he Funds shall be held in an institution whose deposits are insured by a federal agency,
<br />inshumentality, or entity (including Lender, if Lender is an insti#ution whose deposits are so insured) or in
<br />any Federal Home Lnan Bank. Lender shall apply the Funds to pay the E�crow Iterns no later than thc time
<br />speci�ed undar RESPA. Lender shall not eharge Borrower for holding and applying the Funds, annually
<br />analyzing the escrow accottnt, or verify'ing the Escrow Ite�us, unless Lendar pays Borrower interest on the
<br />Funds and Applicablc Law permits Lender to make such a charge. Unless an agre�nrxent is made in writing
<br />or Applicable Law requires interest to be paid on the Funds, Lender shall not be required to pay Borcawer
<br />any interest ar eamings on thc �nda. Sorrower and Lender can agres in writing, however, that interest
<br />shall be paid on the Funds. Lender shall givc ta Barrnwcr, without cha,rgc, an annual accounting nf the
<br />Funds as required by RESPA.
<br />If thero is a surplus of Funds held in escrow, as defined under RESPA, Lender shall account to
<br />Soxrpwer fot the excess funds in accordance with RESPA. If there is a shortage of Funds held in escrow,
<br />as defined under RESPA, Lender shall notity Horrower as required by RESPA, and Borrower shall pay ta
<br />Lender the amount necessary to make up the shortage in accordance with RESPA, but in na mare than 12
<br />monthly payments. If therc is a deficiency of Funds held in escrow, as dcfin�d undor RESPA, Lender shall
<br />notify Borrower as required by RESPA, and Borrower shall pay to Lender the amount necessary to make
<br />up thc deficiency in accordance with RESPA, but in no more than 12 monthly payments.
<br />Upon payment in full of all sums secured by this Spcurity Instrument, Lender shall promptly refund
<br />to Borrowet any Funds held by Lendct.
<br />4. Charges; Liena. Sorrower shall pay all taxes, assessments, charges, fines, and impositions
<br />attributable to the Praperty which can attain priority over this Security Instrument, leasehold payments or
<br />ground renta nn the Property, if any, and Communtty Assaciatinn Dues, Fees, and Assessments, if any_ To
<br />the sxtent that these items arc Escrow Items, Borrawer shall pay them in the manner provided in Section 3.
