<br />(.n "Applicable (,aw" means all controlling applicablc fcdcral, state and local statutes, regulations, ordinances and

<br />(L) "Electronic Funds Transfer" means any transfcr oF funds, other than a transaction originated by check, drafl,
<br />or similar paper instrument, which is initiated through an clectronic terminal, telephonic instrument, computer, ur
<br />magnetic tape so as to order, instruct, or authorizc a financial institution to debit or credit an account. Such term
<br />includes, but is not limitcd to, point-of-sale dransfers, automated tellcr machinc transactions, transfers initiated hy
<br />telephone, wire transfers, and automated clearinghouse transfers.
<br />(A'n "Escrow Items" means those items that arc dcscribed in Section 3.
<br />(N) "Miscellaneous Proceeds" means any compcnsation, sctdcmcnt, award oF damages, vr proceeds paid by any
