201007174 <br />THIS AGREEMENT HAS MADE ANY REPRESENTATIONS OF FACT TO INDUCE THIS <br />WAIVER OF TRIAL BY JURY OR 1N ANY WAY TO MODIFY OR NULLIFY ITS EFFECT. <br />THE AGENT AND THE GRANTOR FURTHER ACKNOWLEDGE THAT THEY HAVE <br />BEEN REPRESENTED (OR HAVE HAD THE OPPORTUNITY TO BE REPRESENTED)1N <br />THE SIGNING OF THIS SECURITY INSTRUMENT AND IN THE MAKING OF THIS <br />WAIVER BY INDEPENDENT LEGAL COUNSEL, SELECTED OF THEIR OWN FREE <br />WILL, AND THAT THEY HAVE HAD THE OPPORTUNITY TO DISCUSS THIS WAIVER <br />WITH COUNSEL. <br />6.1 p State Specific Provisions. In the event of any inconsistencies between this <br />Section and any of the other terms and provisions of this Security Instrument, the terms and <br />provisions ofthis Section shall control and be binding. <br />(a) With respect to the Property which is located in the State of Nebraska, <br />notwithstanding anything contained herein to the contrary, this Security Instrument shall be <br />governed by the Nebraska Trust Deeds Act. <br />(b) It is the true intent and meaning of the Grantor and the Agent, that if the Secured <br />Obligations shall be fully and finally paid and discharged according to the terms of this Security <br />Instrument and the other Financing Documents and all commitments to make additional <br />extensions of credit under the Financing Documents are terminated, then this Security Instrument <br />sha11 automatically cease without any need for notice and be void and, upon request and at the <br />expense of the Grantor, the Agent shall execute and record any and all documents necessary to <br />evidence the termination of this Security Instrument, otherwise it shall remain in full force and <br />virtue. <br />(c) The Grantor hereby requests a copy of any notice of default and any notice of sale <br />hereunder be mailed to the Grantor at the Grantor's address as set forth in the Intercreditor <br />Agreernent. <br />[SIGNATURES ON THE NEXT PAGE] <br />CHARI\1182503v1 <br />14 <br />
