<br />(a) Any arch agreements will nut affect the amounts first Borrower has agreed to pay for Mortgage Insurance, or any <br />other terns of the Loan. Such agreements w'~!1 not increase the amount Borrower wiU owe for Mortgage Insurance, and they <br />will not entitle Borrower to any rCfnnd. <br />(b) Any such agreements will not atTect the rights Borrower des - if any -with respect to the Mortgage Insurance under <br />the Homeowners >pro#ectinn Act of 1998 nr any other law. These rights rt-ay inclyde the right to rticciwe eeatain disclosures, <br />to request and obtain cancellation of the Mortgage hrarranee, to have the Mortgage Insurance terminated automatically, <br />and/or to reeve a refund of any Mortgage Insurance premiums first were rrearrred at the time of arch caneegation or <br />termination. <br />ll. Assignment of Miscellaneous Proceeds;. lforfaiture. All Miscellaneous Proceeds are hereby assigned to and shall be <br />paid to Lender. <br />Tf the Property is damaged, such lvliscellarreotrs Proceeds shall be applied to restoration ar repair of the Property, if the <br />restoration ax repair is econoxxricaily feasible and Lenders security is not lessened- ]hiring such repair anti restoration Period, <br />Lender shall have the right to hold such Miscellaneous Proceeds until Lender has had an opportunity to inspect such <br />Property to ensure the work 'has lien completed to Lender's satistactian, provided that such inspection shall be undertaken <br />promptly. Lender may pay far the repairs and restoration in a single disbursernerrt or in a scales of progress payments as the <br />work is completed. Unless an agreement is made in writing or Applicable Law reyuixes interest to be paid on such <br />Miscellaneous Proceeds, Lender' shall not be required to pay Borrower arty interest or eanvngs on such Mrscellaneaus <br />Proceeds. If the restoration or repaix is not economically feasible or Lcnclds security would be lessened, the Miscellaneous <br />Proceeds shall be applied to the sums secured by this Security Instnrment, whether or not then due, with the excess, if any, <br />paid to Harrower. Such Miscellaneous Proceeds shall be applied in the order provided for in Section 2. <br />In the event of a total taking, destruction, or loss in value of the Property, the Mi~ellacaeaus Proceeds shall be applied to <br />the sums secured by this Security Instrument, whetlarr or not ttren due, with ihs excess, if arty, paid to Borrower. <br />In the event of a partial taking, destruction, or loss in value of the Property in which lire fair market value of the Property <br />immediately before the partial taking, destruction, or loss in value is equal W or greater than the amount of the sums secured <br />by this Security Instrtnnaetrt immediately before the partial taking, destruction, or loss in value, unless Borrowerr and Lender <br />otherwise agree in wilting, the sums secuued by this Secrnity Instrument shall be reduced by the amount of the Miscellaneous <br />Proceeds multiplied by the fnliowing fraction: (a) the total amount of the sums secured immediately before the partial taking, <br />destruction, ox loss in value divided by (b) the fair market value of the Property rmtnediately before the partial taking, <br />Bestruction, or loss in value.
