FISCHER, husband and wife ("Fischer"). <br />WITNESSETH: <br />WHEREAS, Mehring is the owner of the real estate legally described as Lot Two (2), <br />Westgate Eighth Subdivision in the City of Grand Island, Hall County, Nebraska ("Dominant <br />Estate"); <br />WHEREAS, Fischer is the owner of the real estate legally described as Lot Ten (10), <br />Westgate Sixth Subdivision in the City of Grand Island., Hall County, Nebraska ("Servient <br />Estate"); <br />WHEREAS, pursuant to an Easement Agreement dated July 16, 2003 and Eled for public <br />record in the Office of the Register of Deeds of Hall County, Nebraska on July 17, 2003 as <br />Instrument number 200309123 ("Easement Agreement"), a pernianent and perpetual easement <br />for parking upon a portion of the Servient Estate exists for the benefit of the Dominant Estate; <br />and <br />WHEREAS, the parties hereto desire to modify and amend the Easement Agreement in <br />the manner and to the extent as provided as hereinbelow. <br />NOW, THEREFORE, in consideration of the mutual covenants and conditions contained <br />herein valuable considerations, the parties hereto agree as follows: <br />1.
