<br />ELECTRIC EASEMENT
<br />Max A. Mader and Lizbeth N. Mader aka Lizabeth N. Mader, husband and wife,
<br />herein called Grantor, in consideration of the sum of Four Thousand Nine Hundred Ei ht
<br />Five and No/100 Dollars 4 985.00 , receipt of which is hereby acknowledged, hereby
<br />grants and conveys unto the CITY OF GRAND ISLAND, NEBRASKA, a municipal
<br />corporation in Hall County, Nebraska, herein called Grantee, a permanent and perpetual
<br />easement and right-of-way to survey, construct, inspect, maintain, repair, replace, relocate,
<br />extend, remove, and operate thereon, overhead and underground electric lines,
<br />static/ground conductors, communication lines, cables, conduits, pipes, poles, towers,
<br />wires, fibers, anchors, foundations, footings, terminals, transformers, surface markers, and
<br />other appurtenances connected therewith, in, upon, above, along, over, across, underneath,
<br />and through a part of the South Half of the Southwest Quarter (S'~2SW'/) of Section
<br />Twenty-five (25), Township Twelve (12) North, Range Ten (10) West of the 6th P.M. ,Hall
<br />County, Nebraska. The easement and right-of-way being more particularly described as
<br />follows:
<br />The north twenty-seven (27) feet of the south sixty (60) feet of the Southwest
<br />Quarter (SW'/) of Section Twenty-five (25), Township Twelve (12) North, Range Ten
<br />(10) West of the 6th P.M., Hall County, Nebraska.
<br />The above-described easement and right-of-way containing a total of 1.64
<br />acres, more or less, as shown on the plat dated November 9, 2009, marked
<br />Exhibit "A", attached hereto and incorporated herein by reference,
<br />together with the following rights:
<br />Grantee shall have unrestricted ingress and egress to the above-described
<br />easement and right-of-way for any purpose necessary for the surveying, construction,
<br />inspection, maintenance, repair, replacement, relocation, extension, removal, and operation
<br />of such overhead and underground electric utilities and appurtenances. Such rights of
<br />ingress and egress shall be exercised in a reasonable manner.
<br />Grantor consents to the approval of the proposed construction of electrical
<br />transmission lines and appurtenances by the Nebraska Power Review Board and Nebraska
<br />Public Service Commission, without hearing, and waives any and all notice of this matter
<br />before those two regulatory bodies.
