<br />You are hereby given Notice of Default under a Deed of Trust
<br />executed by Virgilio Juarez and Norma Juarez, husband and wife,
<br />dated December 24, 2007, and recorded December 27, 2007, as
<br />Document No. 020071069$, and a Modification of Deed of Trust dated
<br />February 27, 2009, executed by Virgilio Juarez and Norma Juarez,
<br />husband and wife, and recorded March 2, 2009, as Document No.
<br />0200901501, in the Office of the Register of Deeds of Ha11 County,
<br />Nebraska; said Deed of Trust and Modification securing the
<br />following property:
<br />THE NORTHERLY FIFTY SEVEN AND EIGHT TENTHS (57.8)
<br />FEET OF THE EASTERLY NINE AND SIX TENTHS (9.6) FEET
<br />OF LOT NINE (9) AND THE NORTHERLY FIFTY SEVEN AND
<br />EIGHT TENTHS (57.8) FEET OF LOT TEN (10), BLOCK
<br />FIVE (5), ROLLINS' ADDITION, xN THE CITY OF GRAND
<br />ISLAND, HALL COUNTY, NEBRASKA, commonly known as
<br />608 N. Eddy Street, Grand Island, Nebraska
<br />said Deed of Trust being in favor of Five Points Bank, a Nebraska
<br />Banking Corporation, Trustee and Beneficiary under said Deed of
<br />Trust.
<br />Said default under the terms of said Deed of Trust has
<br />occurred by virtue of nonpayment of the payments as they became
<br />due and payable under a Promissory Note dated February 27, 2009,
<br />and designated as Loan No. 101219191, in the principal sum of
<br />FORTY FIVE THOUSAND ONE HUNDRED ONE DOLLARS ($45,101.00), with a
<br />total unpaid principal balance due and owing of Forty One Thousand
<br />Five Hundred Thirty Eight Dollars and Forty Five Cents
<br />($41,538:45), unpaid interest of Three Hundred One Dollars and
<br />Fifteen Cents ($301.15), late charges of One Hundred Sixty Three
<br />Dollars and Sixty Five Cents ($163.65), for a total.. pay off of
<br />FORTY TWO THOUSAND THREE DOLLARS AND TWENTY FIVE CENTS
<br />($42,003.25), and per diem interest accruing at the rate of $8.36
<br />from and after August 24, 2010.
<br />In addition, Trustors are hereby liable to Trustee, Five
<br />Points Bank, for all fees and costs associated with th~.s default
<br />and recovery pursuant to Nebraska Statute §76-1012.
<br />By virtue of said default, Trustee, Five Points Bank, has
<br />determined to sell or cause to be sold the trust property to
<br />satisfy the obligations referred to above.
<br />The default may be cure
<br />filing of this Notice, and the
<br />may be thereby reinstated as
<br />1012.
