That Affiant is the surviving spouse of LEVERN EDWARD <br />O'BRIEN, who died February 1$, 2010, as shown by the certified <br />copy of the Decedent's death certificate attached hereto as <br />Exhibit "A" and by this reference incorporated herein; that <br />Exhibit "A" is a certified copy of the original Certificate of <br />Death on file with the Bureau of Vital Statistics, Department of <br />Health, State of Nebraska. <br />2. That Affiant and the said Decedent were husband and wife <br />on the date of the Decedent's death on February 18, 2010, and <br />were, on said date, the sole owners as joint tenants, not tenants <br />in common, of the real estate legally described as follows: <br />ALL THAT PART OF THE NORTHWEST QUARTER (NW1/4) OF <br />SECTION THIRTY THREE (33), TOWNSHIP TEN (10) NORTH, <br />RANGE TWELVE (12) WEST OF THE 6TH P.M., lying South <br />of U.S. Highway 30, said tract containing approximately <br />58 acres <br />A tract of land comprising a part of the SOUTHWEST <br />QUARTER OF THE SOUTHWEST QUARTER (SW1/4 SWl/4), OF <br />SECTION TWENTY EIGHT (28), TOWNSHIP TEN (10) NORTH, <br />RANGE TWELVE (12) WEST OF THE 6TH P.M., IN HALL <br />COUNTY, NEBRASKA, mare particularly described as <br />follows: Beginning at the Northwest corner of said <br />Southwest Quarter of the Southwest Quarter (SW1/4 <br />SW1/4); thence Easterly along the North line of <br />said Southwest Quarter of the Southwest Quarter <br />(SWl/4 SW1/4), a distance of Thrree Hundred Ninety <br />Nine and Seventy One Hundredths (399.71) feet; <br />thence deflecting right 89°31' and running <br />Southerly, a distance of Three Hundred Ninety <br />Five (395.0) feet; thence deflecting right 7.°38' <br />and running Southwesterly, a distance of Four <br />Hundred Fourteen and Six Tenths (414.6) feet, to <br />the West line of said Section Twenty Eight (28); <br />thence Northerly along the West line of said <br />Section Twenty Eight (28), a distance of Four <br />Hundred Eighty Seven (487.0) feet to the place <br />of beginning and containing 4.071 acres more or <br />less <br />3.
