<br />NOTICE OF LIMITATION ON FUTURE ADVANCES
<br />Pursuant to §76-238.01, Nebraska Statutes
<br />This Notice of Limitation on Future Advances is given on this 5th day of August, 2010, to Bank of Doniphan,
<br />a(n) Corporation, whose address is 118 W Plum, Doniphan, Nebraska 68832 ("Grantee"), by the undersigned.
<br />Pursuant to the terms of an agreement dated April 12, 2004 (the "Agreement"), Grantee may make advances of
<br />credit.
<br />Funds advanced under the terms of the Agreement are secured by a certain deed of trust given to Grantee, dated
<br />April 12, 2004, recorded on April 29, 2004, in Book 0200404197, Page ---, records of Register of Deeds of Hall
<br />County, State of Nebraska (the "Deed of Trust"), under the terms of which Grantee was granted a security interest
<br />in the following described real property located in Hall County, Nebraska (the "Property"):
<br />The Deed of Trust provides that future advances of credit made under the terms of the Agreement shall be secured
<br />by the Deed of Trust, up to a maximum principal indebtedness of $79,000.00, plus accrued interest, any protective
<br />advances made by Grantee to protect Grantee's interest in the Property, and other charges.
<br />The undersigned desires to obtain from Union Bank & Trust Company, a(n) Commercial Bank, whose address
<br />is 2008 North Webb Road, Grand Island, Nebraska 68803 ("Lender"), a loan in the amount of $475,000.00 (the
<br />"Loan"). Lender is unwilling to accommodate this request for said Loan unless Lender obtains a deed of trust on
<br />the Property (the "Subordinate Deed of Trust") and, as an additional condition, Lender requires that any future
<br />advances that Grantee may make under the terms of the Agreement secured by the Decd of Trust be limited and
<br />restricted as set forth herein.
<br />In order to satisfy Lender's conditions for obtaining the Loan, it is the undersigned's express intent to limit,
<br />pursuant to §76-238.01, Nebraska Statutes, the ability to obtain future advances under the terms of the above-
<br />described Agreement and Deed of Trust.
<br />NOTICE IS HEREBY GIVEN TO GRANTEE, pursuant to §76-238.01, Nebraska Statutes, that the abovc-
<br />described Deed of Trust shall secure an amount not to exceed the amount actually advanced and outstanding as of
<br />the date of filing of this Notice, which amount, to the best of the undersigned's knowledge, information and belief,
<br />is $79,000.04.
<br />GRANTEE IS FURTHER NOTIFIED, that the undersigned does hereby waive the right to obtain any additional
<br />or future advances under the terms of the Agreement and Deed of Trust.
<br />This Notice of Limitation on Future Advances may not be rescinded or cancelled during the term of the
<br />Subordinate Dccd of Trust given to Lender, without the consent of Lender.
<br />A copy of this Notice is being sent to Grantee at the address listed above by certified mail.
