<br /> KNOW ALL ME N BY THESE PRES ENTS:
<br />THAT WHEREAS, Under the Nebraska Trust Deeds Act, Neb. Rev.. Stat• §§ 76-1001
<br />to 76-1018 (Reissue 2009), a Trust Deed was executed by Buffalo Properties, L.L.C., a
<br />Nebraska Limited Liability Company, to Geneva State Bank, Trustee, for the benefit of
<br />Geneva State $ank, the beneficiary named therein, dated February 10, 2006, and filed
<br />for record on February 10, 2006 as Instrument #0200601225 in the records of the
<br />Register of Deeds in and for Hall County, Nebraska.
<br />WHEREAS, Trustee filed for record in the office of the Register of Deeds of the
<br />county wherein the property was situated, a Notice of Default, identifying the Trust Deed
<br />by stating the name of the Trustor named therein and giving the book and page numbers
<br />where the same was recorded, a description of the Trust property, and said Notice
<br />containing a statement that a breach of an obligation for which the Trust property was
<br />conveyed as security had occurred, and setting forth the nature of such breach and of the
<br />Trustee's election to sell or cause to be sold such property to satisfy the obligation; and
<br />WHEREAS, after the lapse of not less than one month, the breach or default was
<br />not cured as required by law; and
<br />WHEREAS, the Trustee gave written notice of the time and place of sale
<br />particularly describing the property to be sold by publication of said notice, at least five
<br />(5) times, once a week Far five (5) consecutive weeks, the last publication being at least ten
<br />(10) days but not more than thirty (30) days prior to the sale, in a newspaper having
<br />general circulation in the county in which the property was to be said or some part
<br />thereof was situated, all according to the Nebraska Trust Deeds Act; and
<br />WHEREAS, the sale was held at the time and place designated in the Notice of Sale
<br />which was between the hours of 9:00 a.m, and 5:00 p.m., and was at the courthouse of
<br />the county in which the property to be sold or some part thereof was situated; and
<br />WHEREAS, the Notice of Sale was in substantially the form as provided by the
<br />Nebraska Trust Deeds Act; and
<br />WHEREAS, on the date and at the time and place designated in the Notice of Sale,
<br />the Tnastee sold the property at public auction to Geneva State Bank, which was the
<br />highest bidder, for the sum of One Hundred Thousand Dollars ($100,000); and
<br />and
<br />WHEREAS, the sale was conducted according to the Nebraska Trust Deeds Act;
<br />WHEREAS, the Notice of Default and the Notice of Sale were duly mailed by
<br />registered or certified mail with postage prepaid, to all persons who had requested notice
<br />according to law, ar according to the Deed of Trust, referenced herein; and
<br />WHEREAS, the Trustee has complied with all of the provisions of the Nebraska
<br />Trust Deeds Act.
<br />NOW, THEREFQRE, I, as Trustee under the Deed of Trust herein referenced, as
<br />aforesaid, in consideration of the premises and by virtue of the powers vested in me by
<br />law and by the herein referenced Deed of Trust, do hereby give, grant and convey to said
<br />Geneva State Bank the premises so as aforesaid sold, to-wit:
