201005525 THIS COMBINA"PION REAL ES"1 ATE DEED OF TRUST, ASSIGNMENT OF LEASES AND KENTS, S C R.ITY AGREEMENT ANA )!IXTURE 1±1NANCING STATEMI~NT, dated as of 2010, is made by AURORA COOI'ERA"FIVE ELEVATOR COMPANY, as grantor nd truster (hereinafter called the "Grantor"), a corporation existing under the laws of the State of Nebraska, to CoBANK, ACB, as trustee (in such capacity, the "Trustee"), whose office is located at 5500 South Quebec Street, Greenwood Village, Colorado 80111, for the benefit of CoBANK, ACB a federally chartered instrumentality of the United States (hereinafter called "CoBank" or the "Beneficiary"), in its capacity as administrative agent for the Lenders (as deiincd herein). AR'1")<CLE 1. DEFiNITIUNS Section 1.01. Definitions. In addition to the terms defined elsewhere in this Deed of Trust, the following terms shall have the meanings specified in this Section 1.01, unless the context clearly requires otherwise. The ternas defined herein include the plural as well as the singular. Beneficiary shall mean CoBank, ACB, as administrative agent for the Lenders. Collateral shall mean all of the property, interests and rights in the Trust 1~;state conveyed by Grantor to Beneficiary in Section 2.01. Credit Agreements shall mean all agreements, instruments and documents between the Grantor and the Beneficiary or executed by the Grantor in favor of the Beneficiary which evidence or relate to the Obligations, whether now existing or hereafter entered into, and all amendments, supplements and restatements thereat; including without limitation the Initial Credit Agreement. Deed of Trust shall mean this Real Estate Deed of Trust, as it may be amended or supplemented from time to time. Environmental Law.shall have the meaning specified in Section 3.13. Event of Default shall laave the meaning specified in Section 5.01. Hazardous Materials shall have the meaning specified in Section 3.13. Initial Credit Agreement shall mean that certain Credit Agreement dated as of July 31, 2009, by and among Grantor, as Borrower, and CoBank, as Administrative Agent, as may be amended or supplemented fxom time to time.
