That said Deed and <br />conveyance made by the Affiants is executed and delivered with the <br />express understanding that its receipt by the Grantee does not <br />constitute legal delivery and shall be of no binding farce and <br />effect whatsoever until such time as the said Deed and the release, <br />satisfaction or cancellation of the lien of said Deed of Trust are <br />filed for record in the office of the Register of Deeds of the <br />county in which the property is situated, at which time the full <br />legal and equitable title shall vest in the Grantee, but it is the <br />intention of the parties, supported by their presentations and <br />war.ra~-ities of t~es~ Affi:~nts, that *he Grantee. shal'p. ±-`~ke <br />unencumbered title, and therefore the vesting title shall not <br />operate to effect such a merger of interests as to extinguish the <br />mortgage lien if such extinguishment might serve to promote the <br />priority of any subordinate interests which may be outstanding at <br />the time of such vesting of title. That they own no other property <br />which is subject to a Deed of Trust held or insured by Beneficial <br />Financial 1, Inc. This Affidavit is made for the protection and <br />benefit of the aforesaid Grantee, its successors and assigns, <br />Beneficial. Financial ~., Inc., and all other parties hereafter <br />dealing with or who may acquire any interest in the above <br />referenced property. <br />Gary Wilson and Carolyn Sue Wilson, and Beneficial Financial <br />1, Inc., agree that this Agreement for Deed and Estoppel and <br />Solvency Affidavit and the transaction contemplated herein are a <br />~r~ut~:al., foil, aiad corrip~tet;a settlentea-.t, disc~~.arge arch, re:Ledse of <br />Grantors, and Grantee's claims relating to the deed of trust, <br />including, without limitation, their rights and obligations with <br />respect to the rescission of the deed of trust pursuant to the <br />Truth-in-Lending Act, Federal Reserve Regulation Z, or any other <br />applicable law; and Gary Wilson and Carolyn Sue Wilson further <br />acknowledge that they have elected to proceed with this Agreement <br />for Deed and Estoppel and Solvency Affidavit and the transactions <br />contemplated herein in lieu of any other rights or actions that <br />they might pursue with respect to rescission either now or in the <br />-3- <br />
