2oioa~474 <br />Lessees shall not exceed One Hundred Dollars ($100.00) unless a majority of all lessee- <br />stackhalders of Kuester Lake, Inc. (one vote for each share), present and voting at a <br />special meeting called far that purpose, shall approve the same. <br />6. Access. The Lessee shall have access from the leased premises onto the <br />Lessor's roads and shall also have the right to use the lake far boating, swimming, and <br />fishing. These access rights are in common with the other leaseholders at Kuester Lake. <br />6a. Prior Leases. This Lease replaces and supersedes any prior Lease for said <br />premises which the Lessee ar his predecessors in title may have held. <br />7. Determination of Boundaries. The Lessor shall have the right, on a <br />reasonable basis, to determine the boundaries between the Lessee and his neighbors if <br />the Lessee and his neighbors cannot agree to such boundary line. The lake front <br />boundary of the leased premises shall be to the water line as the same may exist from <br />time to time with changes in the water level of the lake. The boundary line of the leased <br />premises abutting the Lessor's common roads shall be reasonably determined by the <br />Lessor. <br />i3. Peaceful Possession. As long as Lessee conforms with the requirements <br />binding upon them in this Lease Agreement, the Lessee shall enjoy peaceful possession <br />of the leased premises. <br />9. Improvements. The Lessee shall keep the leased premises in a neat and <br />clean condition at all times and shall keep all improvements on the leased premises in a <br />good condition of repair. <br />10. Abandonment. The Lessee agrees not to abandon the leased premises. <br />11. Access for Ins_tallin~ Utiliiy Lines. The Lessor reserves the right to come <br />upon the leased premises for installation of underground orabove-ground utility lines and <br />the making of necessary repairs or improvements to or abutting the leased premises. <br />The Lessor agrees to restore the premises to substantially the same condition as they <br />were before any such installation and at the Lessor's expense. <br />12. Access for Outlet„Pipe. Lessor states that there is a 10" underground lake <br />overflow outlet pipe buried under the surface of the leased premises at the location <br />shown on the map attached hereto as Exhibit "A". Lessee acknowledges that he is aware <br />of the location of the buried pipe. Lessee further acknowledges that the Lessor reserves <br />the right to have unobstructed access to the premises for the purpose of maintaining, <br />repairing, replacing or removing the overflow outlet pipe. Lessee further acknowledges <br />that he cannot build a structure over the space that the buried pipe is located. This <br />access right belongs to the Lessor and runs with the land and is binding upon all Lessees <br />or other users of the premises. <br />13. Rules and Regulations. The Lessee agrees to comply with the rules and <br />regulations as prepared and furnished by the Lessor to the Lessee, from time to time. <br />Such rules and regulations shall contain restrictions and limitations, far the mutual benefit <br />of all Lessees at Kuester Lake, pertaining to the use by the several Lessees at Kuester <br />Lake of the lake itself, common roads, and the leased premises. It is understood that the <br />basic use of the leased premises shall be far residential purposes, but the Lessor may <br />permit, from time to time, commercial activities on the leased premises. Any such rules, <br />regulations and permits are subject to change by the Lessor, excepting that the basic <br />purpose of the leased premises as residential shall not be abridged. Any changes in the <br />rules and regulations must be approved by a majority of the leaseholders present and <br />voting at a meeting called for such purpose of which written notice has been given to all <br />leaseholders (one vote per Lease). <br />14. Occupancy and Use. Only dwellings intended for occupancy by one family <br />may be constructed upon the leased premises and occupancy by more than one family in <br />any such dwelling shall not be permitted. In no event shall the leased premises be <br />utilized fvr any commercial ar business enterprise. <br />
