<br />THIS DEED OF TRUST is made and entered into this 20`h day of Iuly, 2010 by and
<br />between BOT INVESTMENTS AND ASSOCIATES, LLC, a Nebraska limited liability ~\
<br />company, whale mailing address is 2135 Diers Avenue, Grand Island, Nebraska d$$02, ~~~
<br />hereinafter referred to as ("Trustor"); OLD REPUBLIC NATIONAL TITLE INSURANCE c>
<br />COMPANY, hereinafter referred to as ("Trustee"), whose mailing address is 11960 Westline
<br />Industrial Drive, Suite 230, St. Louis, Missouri 63146; and UNITED WESTERN BANK, whose
<br />mailing address is 700 17"' Street, Suite 1000, Denver, Colorado 50202, hereinafter referred to
<br />as ("Beneficiary ").
<br />1. For valuable consideration, including the indebtedness identified herein and the trust
<br />created hereby, the receipt of which is hereby acknowledged by Trustor, Trustar hereby
<br />irrevocably grants, transfers, and assigns to Trustee, intrust, WITH POWER OF SALE for the
<br />benefit and security of Beneficiary under the terms and condztians hereinafter set Earth, the real
<br />estate in Hall County, Nebraska legally described on Exhibit "A" which exhibit is attached hereto
<br />and made a part hereof by reference. The street address of Trustar with respect to the above
<br />described real estate is 2135 Diers Avenue, Grand Island, Nebraska 68802, together with all of
<br />Trustor's right, title and interest in and to the above described real estate, now awned ar hereafter
<br />acquired, including all buildings, improvements, fixtures, and fences now on or to be placed on
<br />the real estate; all appurtenance thereto, including water, water rights and drainage rights; all
<br />rents, issues, uses, income, profits, and the right to possession of the real estate; all mineral rights
<br />whatsoever, including all oil, gas, gravel, rock, and other materials of whatever nature, including
<br />geothermal resources; all personal property that may be integrally belonging to or hereinafter
<br />becoming an integral part of the real estate, whether attached ar detached, including buildings,
<br />sheds, garages, and other appurtenances of any structure ar building secured hereby; all easements
<br />and other rights, now or at any time hereinafter belonging to ar in any way pertaining ta, the real
<br />estate, whether ar not specifically described herein; all leases, permits, licenses, or privileges
<br />appurtenant or nonappurtenant to the real estate, now or hereafter issued, extended ar renewed
<br />far or by Trastor; and all homestead or marital interests, if any, which interests are hereby
<br />released and waived; all of which, including replacements and additions thereto, are hereby
<br />declared to be part of the real estate secured by the lien of this Deed of Trust and all of the
<br />foregoing hereinafter referred to as ("Premises").
