201003815 <br />4.3 Conservation. To control soil erosion as completely as practicable; to keep in good repair all <br />terraces, open ditches, onlets and outlets of the drains; to preserve all established watercourses or <br />ditches, including grassed waterways; to refrain from any operation or practice that will injure such <br />structures; to exercise due care to insure water runoff does not adversely affect neighbors; to adopt a soil <br />conservation program based on a conservation plan as developed by the local natural resources district; <br />that failure of the Lessee to utilize the Property for agricultural purposes or failure to observe and carry <br />out soil conservation requirements as provided in the rules and regulations of the local natural resources <br />district, department, commission, or board, shalt be cause for cancellation of this Lease. <br />4.4 Addition of improvements. To not erect or permit to be erected upon said Property, any <br />structure, building, fence, or sign of any kind whatsoever, except by the written consent of the Lessor and <br />will not make a claim for labor at any time unless Lessor has given written permission at a previous date; <br />to not add electrical wiring without written permission of the Lessor, and when same is given, such wiring <br />shall be inspected and approved by the local power company; and that said wiring shall immediately <br />become part of the Property against which the Lessee will have no further claim. <br />4.5 Damages. Lessee shall be responsible for, and pay for, any damages to the Property From <br />causes in the Lessee's control and that ordinary wear and depreciation or damages outside the control of <br />the Lessee are excepted. <br />4.6 Agricultural Programs. To consult with the Lessor about, and abide by Lessor's decision in <br />reference to, compliance with the U.S. Department of Agriculture ("USDA") program participation; to <br />follow the U5DA Natural Resources Conservation Service recommendations and fulfill all other <br />requirements necessary to maintain the rights of current and future operators of this Property for farm <br />use; to participate in federal farm programs; and to report planted acreages of crops as required by the <br />U5DA, Farm Service Agency. <br />4.7 Storage and Use of Herbicides, Pesticides and Fertilizers. To store and use herbicides, <br />pesticides, fertilizers, and other chemicals, and dispose of herbicides, pesticides, fertilizers, and other <br />chemicals containers in accordance with state and federal regulations and recommendations ;and to <br />furnish the lessor a written field by field record of the amount, kinds, and dates of applications of <br />herbicides, pesticides and fertilizers submitted along with the December payment each year for the Term <br />of this lease. <br />4.8 Storage of Wazardous Chemicals. To not store motor vehicles, tractors, fuel, and chemicals <br />on the Property in violation of those certain restrictions in the Lessor's insurance policies. <br />4.9 Yielding Possession at End of Lease. To yield possession of the Property to the Lessor <br />without further notice at the Expiration Date of this Lease. <br />5. Insurance. Lessee shall provide certification it has obtained all the insurance required hereunder, as <br />applicable, and such insurance has been approved by the Lessor. Approval of the insurance by the Lessor <br />does not relieve or decrease the liability of the Lessee hereunder. If by the terms of any insurance a <br />mandatory deductible is required, or if Lessee elects to increase the mandatory deductible amount, Lessee <br />shall be responsible far payment of the amount of the deductible in the event of a paid claim.
