<br />KNOW ALL MEN BY THESE PRESENTS: That Ronald S. Depue, a
<br />member of the Nebraska State Bar Association and Successor Trustee, ~''
<br />upon a Deed of Trust made and entered into on or about November 10, a
<br />2006, by and between Warren J. Kirsch, a single person, Trustor,
<br />and Concept Fiberglass Homes, Inc., a Nebraska corporation,
<br />Beneficiary, and Gary D. Byrne, Trustee, which Deed of Trust was
<br />filed on November 13, 2006, in the Register of Deeds office of Hall
<br />County, Nebraska, as Document No. 0200610..28, herein called the
<br />Grantor, in consideration of Four Hundred Twelve Thousand Dollars
<br />($412,000.00), received from Grantee, does hereby grant, bargain,
<br />sell, convey and confirm unto Concept Fiberglass Homes, Inc.,
<br />herein called the Grantee, the following described real property in
<br />Ha11 County, Nebraska:
<br />Lots One (1), Ten (10), Eleven (11), Twelve (12),
<br />Thirteen (13) and Fourteen (14), Concept Subdivision in
<br />the City of Grand Island, Hall County, Nebraska.
<br />TO HAVE AND TO HOLD the above described premises together with
<br />all tenements, hereditaments, and appurtenances thereto belonging
<br />and to the Grantee.
<br />Grantor does hereby covenant with Grantee as follows:
<br />1. That Warren J. Kirsch, Trustor, failed to pay the
<br />Beneficiary payments which were contractually due and the Grantor,
<br />at the request of the Beneficiary, elected to declare the entire
<br />unpaid principal balance together with interest thereon at once
<br />immediately due and payable;
<br />2. That a notice of default was filed by Grantor on March 8,
<br />2010, in the Register of Deeds office of Hall County, Nebraska, as
<br />Document No. 0201001508. A copy of the notice of default was
<br />served upon Warren J. Kirsch, Trustor, by certified mail, postage
<br />prepaid on March 15, 2010;
<br />3. The Trustor, Warren J. Kirsch, failed to cure the default
<br />referenced in the notice of default within thirty days after the
<br />service of the notice of default;
