STATEMENT OF PiJRPOSE. The purpose of this License Agreement is to set forth the terms and conditions under which the Licensee may construct, maintain, repair, and utilize the following described improvement which will infringe upon a utilities easement, as well as City owned property: To place a landscaped earthen berm on the northwest end of Outlot A, Kenmare Subdivision and on the west end of 2508 S Blaine Street. 2. DESCRIPTION Ob' LICENSEE'S REAL ESTATE. The Licensee owns the following described real estate subject to the Licensor's utility easement to which this License Agreement shall apply: Outlot A, Kenmare Subdivision, except that part deeded to the City of Grand Island in Document # 95108446 recorded in the office of the Hall County Register of Deeds. 3. STORMWATER PROTECTION. The Licensee will ensure compliance under the National Pollutant Discharge Elimination System (NPDES) General NFDES Permit Number NER110000 for Storm Water Discharges from construction sites to waters of the State of Nebraska. This NPDES general permit is issued in compliance with the provisions of the Federal Water Pollution Control Act (33 U.S.S. Secs. 1251 et. seq. as amended to date), the Nebraska Environmental Protection Act (Neb. Rev. Stat. Secs. 81-1501 et. seg. as amended to date), and the Rules and Regulations promulgated pursuant to these Acts.
