Lockwood, Trustee, as owner of the real property, respectively, described as: The North Half of the Southeast Quarter (N1/2SE1/4) and the Southwest Quarter of the Southeast Quarter (SW1/4SE1/4), Section Thirty-six (36), Township Eleven (11) North, Range Eleven (11) West of the 6th P.M., Hall County, NE subject to easements and restrictions of record. In consideration of One Dollar and Other Good and Valuable Consideration, receipt of which is hereby acknowledged, and to induce Heritage Bank in Wood River, NE to make - - certain loads to Rola~id R. Eii~;el and Sandra E.Engel, secured by the described personal property located on the above described premises, the undersigned do hereby covenant and grant unto said Heritage Bank in Wood River, NE as follows: That whereas, Roland R.Enge1 and Sandra E. Engel have constructed upon said premises or placed on said premises the following personal property: 1991 8-Tower Reinke Pivot, Serial# 291-C7123-665 2003 Case Cummins Diesel .Power Unit ].000 Gallon Fuel Tank At their expense and with our consent and approval, it is hereby agreed that Roland R. Engel and Sandra E. Engel shall have full right to remove said personal property at any time. The undersigned further agree that for all purposes herein, said personal property, structures and improvements shall be considered the personal property of Roland R. Engel and Sandra E. Engel; that the same shall remain severed from the land at all times even though physically attached; that the same shall be removable and with regard to the rights of these parties and the rights of Heritage Bank in Wood River, NE pursuant to any lending or security agreements executed by Roland R. Enamel and Sandra E. Enge] shall be considered as personal property and shall not become a fixture; that at no time shall any lien, encumbrance or conveyance of any interest in the real estate referred to herein apply to these structures; that in the even of any default pursuant to the lending agreerr~ents and security agreements with Heritage/$anlc-i.r~Wood-River, NE co~~ering the above described real estate, Heritage Bank in Wood River, NE may enter upon the premises, take possession of and remove the personal property or otherwise exercise its rights therein without notice to the undersigned.
