PETERSON, hereinafter refez~red to as the "Licea~zsee". <br />1. STATEMENT OF PURPOSE. The purpose of this License Agreement zs to <br />set forth the teens and conditions under which the Licensee may construct, maintain, repair, <br />and utilize the following described improvement which will infringe upon the public right-oF <br />way; <br />T'o place a pipe in the public right-of--way immediately behind the sidewalk, in tiont of <br />3103, 3107, 3111 & 3115 Brentwood Boulevard (Lots 18, 19, 20 & 21, all in 131oc1c 3 of <br />Brentwood Second Subdivision} for the discharge of gro>rzndwatex directly to a stoz°xa~ drainage <br />curb inlet. The Licensee will be responsible far restoring the surface to the same condition it <br />was in prior to the work being done. This license agreement is solely for permission to place <br />a pipe in the right-of--way and a storm sewer tap permit will be issued far floe cozanection to <br />the storm sewer system. <br />2. DESCRIPTION OF REAL ESTATE AFFECTED. This License Agreeznez~t <br />applies to the city right-of--way abutting Lots 1$, 19, 20 & 21, all in Block 3 of Brentwood <br />Second Subdivision; located at 3103, 3107, 3111 & 3115 Brentwood Boulevard <br />3. LICENSEE'S DUTIES AND RISKS. It is uaaderstood and agz•eed that the <br />Licensee may construct, maintain, repair and utilize the above described improveza~aent at the <br />Licensee's sole risk. The Licensee hereby waives azay claim for damages against the <br />Licensor, its officers, employee, agents and independent contractors for any damage or irajury <br />that. may result to said improvement. If the Licensor, in its sole discretion, determines that <br />any part or all of the improvement must be removed or is damaged by the Licensor, i.ts <br />employees, agents or independent contractors working for the Licensor during tl~e course of <br />their employment or duties with the Licensor, the Licensee agrees to assume and pay all costs <br />relating to the replacement ar repair of the improvement.
