<br /> TRUSTEE'S DEED
<br />This instrument, made this 26t1i day of April, 2010, between Eric H. Lindquist, a member of
<br />the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor", pursuant to a
<br />power of sale contained in that certain Deed of Trust recorded on July 6, 2pOS as Instrument No.
<br />0200506106 in the office of the Register of Deeds of Hall County, Nebraska, and The Bank of New
<br />York Mellon f/k/a The Bank of New York as successor to JPMorgan Chase Bank, N.A., as
<br />trustee for the benefit of the Certificateholders of Popular ABS, Inc. Mortgage Pass-Through
<br />Certificates Series 2005-4, hereinafter called "Grantee".
<br />WHEREAS, on January 28, 2010, Grantor, executed a Notice of Default pursuant to which
<br />notice was given to Cynthia Kay Montgomery, a single person, Trustor, under that certain Deed of
<br />Trust recorded on July 6, 2005 as Instrument No. 0200506106 in the office of the Register of Deeds
<br />of Hall County, Nebraska, covering that certain premises described as:
<br />The westerly Fifty (50) feet of Lot Seven (7), in Block One (1), of Gideon's
<br />Addition to the Village of Doniphan, Hall County, Nebraska,
<br />tha± a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on February 1, 2010, as Instrument No. 0201000678.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. §76-1008.
<br />Subsequent thereto, beginning on March 12, 2010, Grantor caused to be published in The
<br />Grand Island Independent, a newspaper having a general circulation in Hall County, Nebraska, a
<br />Notice of Trustee's Sale setting forth a description of the property to be sold and stating that the
<br />described property would be sold at public auction to the highest bidder for cash or certified ar
<br />cashier's check, at the lower level lobby of the Hall County Courthouse, 1st & Locust Street, Grand
<br />Island, Hall County, Nebraska at 2:00 p.m. on Apri120, 2010. Publication of such notice was made
<br />for five consecutive weeks on March 12, 2010, March 19, 2010, March 26, 2010, April 2, 2010 and
<br />April 9, 2010, the last publication being at least ten (10) days but not more than thirty (30) days
<br />prior to the date of sale.
<br />_ A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. §76-1 X08.
<br />Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney for Grantor, did at
<br />the time and place mentioned in said Notice of Trustee's Sale, alder said property for sale at public
<br />auction, and did sell the same to Grantee for the sum of $50,000.00, it being the highest bidder
<br />therefor.
<br />NOW, THEREFORE, in consideration of the premises and of the sum of $50,000.00 sa bid
<br />and paid as aforesaid, I, Grantor, da hereby grant and convey unto said Grantee, its successors and
<br />assigns forever, all the estate, right, title and interest of which the said Cynthia Kay Montgomery, a
<br />single person, Trustor, and her successors in interest, were seized ar possessed at the time said Deed
<br />of Trust was given, or at any time thereafter, in and to the premises sold as aforesaid, to-wit;
