Donoghue, being first duly sworn upon his or her oath, deposes and says: 1. That the Affiant is now the sole trustee under the John F. Donoghue and Jacquelyn L. Donoghue Trust Agreement dated August 8, 2005 (hereinafter referred to as the "said Trust"). 2. That on December 14, 2009, the Aff'iant became the sole trustee of the said Trust upon the death of John F. Donoghue, who was one of the settlors and initial cotrustees of said Trust, A certified copy of the death certificate for John F. Donoghue is attached hereto, marked Exhibit "A", and made a part hereof by this reference. 3. That the Afliant remains the sole trustee of the said Trust as of this date. 4. That among the assets of the said Trust is the fo.llorving described real property that was conveyed to the cotrustees of the said Trust on. August 8, 2005, by'Warranty Deed recorded on August 1.0, 2005, in the records of the Hall County Register at Instrument No. 200507758: Lot Three (3), Block Fourteen (14), Fairview Ptak Addition to the City of Grand Island, Hall County, Nebraska. 5. That pursuant to the terms ofthe said Trust and §30-3881(2) ofthe Nebraska Uniform Trust Act, the trustee of the said Trust has the power, without court authorization, to acquire or sell .property, for cash or on credit, at public or private sale. 6. That neither the said Trust or the trust instrument creating the said Trust, nor any part thereof, has been revoked, amended, or terminated, and the above statements constitute a full disclosure of all provisions concerning those items.
