241442498 <br />entitled to receive and retain the full amount of the debt evidenced by the Note, the 2007 Nate or <br />the 2003 Loan Agreement, and the other liabilities herein described, in any action for <br />foreclosure, redemption by Grantor, accounting for the proceeds of a foreclosure sale, or of <br />accounting far insurance proceeds or any condemnation award. Nothing in the preceding <br />paragraph contained shall in any way lessen or impair the rights of Beneficiary with respect to <br />this Deed of Trust and the Nate. The Nate and the 2007 Note and the 2003 Loan Agreement <br />shall be and remain separate obligations of Grantor and Subsidiaries respectively, and the Nate, <br />the 2007 Note and the 2003 Loan Agreement, and the security therefor, shall be separately <br />enforceable according to their terms. Beneficiary may institute separate proceedings with <br />respect to the Note and the 2007 Note and the 2003 Loan Agreement, and the security therefor <br />simultaneously or in such order and at such times as Beneficiary may elect. The pendency of <br />any proceedings with respect to the Nate, the 2007 Note, the 2003 Loan Agreement, ar any <br />security therefor, shall not be grounds for the abatement or for hindering, delaying or preventing <br />any other proceedings with respect to the Nate, the 2007 Note, the 2003 Loan Agreement, or any <br />security therefor. Default tinder the Nate, the 2007 Note or the 2003 Loan Agreement, or any <br />security therefor shall constitute a separate cause of action, and the institution of proceedings <br />upon one but not both shall not be construed as a splitting of a cause of action by Beneficiary. <br />(REMAINDER OF THIS PAGE INTENTIONALLY LEFT BLANK) <br />13 <br />
