<br />TRl ISTEE'S DEED
<br />
<br />This instrument, made this 12 day of October, 2005, between Eric H. Lindquist, a member
<br />of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor", pursuant to a
<br />power of sale contained in that certain Deed of Trust recorded on July 10, 1998 as Instrument No.
<br />98-106777 in the office of the Register of Deeds of Hall County, Nebraska, and Onyx Investment,
<br />L.L.c., hereinafter called "Grantee":
<br />
<br />WHEREAS, on July 18,2005, Eric H. Lindquist, as Successor Trustee, executed a Notice of
<br />Default pursuant to which notice was given to Andrew D. Thompson, Anthony D. Thompson and
<br />Nancy L. Thompson, all single persons, Trustors, under that certain Deed of Trust recorded on July
<br />10, 1998 as Instrument No. 98-106777 in the office of the Register of Deeds of Hall County,
<br />Nebraska, covering that certain premises described as:
<br />
<br />THE WEST 67.5 FEET OF THE EAST 135 FEET OF LOT 13, OF THE COUNTY
<br />SUBDIVISION OF THE W Y2 OF THE SW lJ.t OF SECTION 15, TOWNSHIP 11
<br />NORTH, RANGE 9, WEST OF THE 6TH P.M., BEING A RECTANGULAR
<br />TRACT OF GROUND HAVING A NORTH FRONTAGE OF 67.5 FEET ON
<br />CHARLES STREET IN THE CITY OF GRAND ISLAND, HALL COUNTY,
<br />NEBRASKA, AND DEPTH OF 65 FEET,
<br />
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfY
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on July 20, 2005 as Instrument No. 0200506831.
<br />
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76-1008 R.R.S. Nebraska.
<br />
<br />Subsequent thereto, beginning on August 31,2005, Grantor caused to be published in the
<br />Grand Island Daily Independent, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and stating
<br />that the described property would be sold at public auction to the highest bidder for cash or certified
<br />or cashier's check, at the lower level lobby of the Hall County Courthouse, 1 st & Locust Street,
<br />Grand Island, Hall County, Nebraska, at 2:00 p.m. on October 13,2005. Publication of such notice
<br />was made for five consecutive weeks on August 31, 2005, September 7,2005, September 14,2005,
<br />September 21,2005 and September 28,2005, the last publication being at least ten (10) days but not
<br />more than thirty (30) days prior to the date of sale.
<br />
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76-1008
<br />RRS. Nebraska.
<br />
<br />Pursuant to said Notice of Trustee's Sale, John McDermott, attorney for Eric H.
<br />Lindquist, Successor Trustee, did at the time and place mentioned in said Notice of Trustee's
<br />Sale, offer said property for sale at public auction, and did sell the same to Grantee for the sum
<br />of $26,500.00, it being the highest bidder therefor.
