POWELL and JANICE G. <br />POWELL, Husband and Wife, hereinafter referred to as "GRANTOR ", for valuable <br />consideration, receipt of which is hereby acknowledged, does hereby give grant and convey unto <br />the VILLAGE OF ALDA, NEBRASKA, a municipal corporation, "GRANTEE ", a perpetual <br />easement and right-of-way over, across, under, through and upon the following- described real <br />estate, to -wit: <br />A tract of land in the Southeast Quarter (SE1 /4), Section Thirty-Two (32), <br />Township Eleven (11) North, Range Ten (10) West of the 6th P.M., Hall County, <br />Nebraska, and more particularly described as follows: <br />Commencing at the Southeast Corner said Southeast Quarter (SE 1 /4) thence <br />N00 °05'57E (assumed bearing) along the east line said Southeast Quarter <br />(SE 1 /4) a distance of 962.68 feet; thence S57'56'1 I "W a distance of 366.79 feet <br />to the west line of Powell Second Subdivision and the Place of Beginning; thence <br />S57'56'1 I "W a distance of 732.41 feet to the beginning of a curve concave to the <br />northeast subtended by a radius of 714.49 feet; thence along said curve the chord <br />of which bears N88° 13'48 "W an arc distance of 35.92 feet; thence N57'56'1 I "E <br />a distance of 774.81 feet to the west line of Powell Second Subdivision; thence <br />S00 °04'22 "W along said west line a distance of 23.62 feet to the Place of <br />Beginning. <br />Said easement includes, but is not limited to, the right to install, construct, maintain, replace and <br />operate a water line or lines by the GRANTEE within the described easement area in connection <br />with its public water supply system. It is further provided that said easement shall be deemed to <br />provide GRANTEE with the right of unrestricted access to its water line or lines by ingress and <br />egress over, across, through and under the lands herein described, together with all rights of <br />ingress and egress necessary for the full and complete use, occupation and enjoyment of the <br />easement hereby granted, including the right to excavate and refill ditches and trenches for the <br />location of said municipal water line or lines and appurtenant structures related thereto. <br />In addition to the perpetual easement hereinabove granted, GRANTOR, for the purpose <br />of permitting initial construction, stockpiling of materials, parking of equipment and <br />encroachment necessary to initially install pipes and related equipment for such water line, grants <br />and conveys unto GRANTEE a temporary construction easement ( "Temporary Easement ") over, <br />through and across that real estate hereinafter described as: <br />A tract of land in the Southeast Quarter (SE 1 /4), Section Thirty -Two (32), <br />Township Eleven (11) North, Range Ten (10) West of the 6th P.M., Hall County, <br />Nebraska, and more particularly described as follows: <br />Commencing at the Southeast Corner said Southeast Quarter (SE 1 /4) thence <br />N00 °05'57E (assumed bearing) along the east line said Southeast Quarter <br />(SE1 /4) a distance of 962.68 feet; thence S57 °56'1 1 "W a distance of 366.79 feet <br />to the west line of Powell Second Subdivision; thence N00 °04'22 "W along the <br />west line said Powell Second Subdivision a distance of 23.62 feet to the Place of <br />Beginning; thence S57 °56' 11 "W a distance of 774.81 feet to the beginning of a <br />curve concave to the northeast subtended by a radius of 714.49 feet; thence along <br />said curve the chord of which bears N84 °48'09 "W an arc distance of 49.56 feet; <br />thence N57'56'1 1"E a distance of 833.09 feet to the -west lire of Powell Second <br />Subdivision; thence S00 °04'22 "W along said west line a distance of 35.43 feet to <br />the Place of Beginning. <br />This Temporary Easement shall expire at such time as the initial installation of pipe shall have <br />been completed and accepted by the GRANTEE from the contractor undertaking such <br />installation on behalf of GRANTEE. <br />To have and to hold the same unto the said GRANTEE, its successors and assigns as <br />appurtenant to the land and every part thereof, and GRANTOR hereby dedicates his interests in <br />said real estate to the use of the GRANTEE.
