<br />KNOW ALL MEN BY THESE PRESENTS that PATRICK K. NIELDS, is the y
<br />Successor Trustee under a Deed of Trust made and entered into on or about March 30, 2007, by and ~
<br />between SARAH MARIE EHLERS, a single person and BRYAN DAVID RAILE, a single ~'
<br />person, Trustors, and U.S. BANK TRUST COMPANY, NATIONAL ASSOCIATION, Trustee,
<br />PLATTE VALLEY STATE BANK & TRUST CO., Beneficiary. Said Deed of Trust was
<br />recorded on March 30, 2007 as Instrument No. 200702561 in the office of the Register of Deeds for
<br />Hall County, Nebraska. Said Deed of Trust having been assigned by virtue of an Assignment dated
<br />March 30, 2007 to U.S. BANK, N.A., and which was filed for record on March 30, 2007 as
<br />Instrument No. 200702562 in the office of the Register of Deeds for Hall County, Nebraska.
<br />PATRICK K. NIELDS was appointed Successor Trustee by virtue of a Substitution of Trustee
<br />dated October 9, 2009, and retarded November 23, 2009, as Instrument No. 200909253 in the office
<br />of the Register of Deeds for Hall County, Nebraska. PATRICK K. NIELDS, Grantor, in
<br />consideration of the sum of Thirty Nine Thousand One Dollar and 00/100 Dollars ($39,001.00) and
<br />other good and valuable consideration received from NICE HOMES, INC., does hereby grant,
<br />bargain, sell, convey and confirm unto NICE HOMES, INC., (hereinafter "Grantee" where
<br />appropriate), the following-described real property in Sarpy County, Nebraska, to wit:
<br />LOTS FIVE (5), SIX (6) AND SEVEN (7) EXCEPT THE WEST TWENTY TWO
<br />(W22') FEET OF LOT SEVEN (7), IN BLOCK FOUR (4), DILL AND HUSTON'S
<br />ADDITION TO THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA
<br />to have and to hold the above-described premises together with all tenements, hereditaments and
<br />appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns forever.
<br />Grantor does hereby covenant with Grantee and Grantee's successors and assigns:
<br />1. That SARAH MARIE EHLERS, a single person and BRYAN DAVID RAILE, a single
<br />person, as Trustors, failed to pay to Beneficiary payments which were contractually due, and
<br />the Grantor, at the request of the Beneficiary, elected to declare the entire unpaid principal
<br />balance, together with interest thereon at once immediately due and payable.
<br />2. That a Notice of Default as required by § 76-1006 was filed by Grantor on November 23,
<br />2009, as Instrument No. 200909254 in the Office of the Register of Deeds of Hall County,
<br />Nebraska. A copy of said Notice of Default was thereafter mailed to all parties entitled to
<br />notice, pursuant to said Deed of Trust and in compliance with § 76-1008, R.R.S. Nebraska.
<br />3. That the Trustor failed to cure the default referenced in the Notice of Default within 30 days
<br />after filing of the Notice of Default.
<br />4. That a Notice of Trustee's Sale was filed by Grantor on February 5, 2010, as Instrument No.
<br />201000805 in the office of the Register of Deeds of Hall County, Nebraska. A copy of said
<br />Notice of the time and place of the sale was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with § 76-1008, R.R.S. Nebraska.
<br />5. That Grantor as required by § 76-1007 published a Notice of Trustee's Sale to be held on
<br />March 23, 2010, at 10:00 a.m. in the lower lobby of the Hall County Courthouse, 11 l West
<br />First Street, Grand Island, Nebraska Said Notice was published in the Grand Island
<br />Independent, a legal newspaper of Grand Island, Hall County, Nebraska, once a week for five
<br />consecutive weeks commencing on February 8, 2010, and ending March 8, 2010. The last
<br />publication notice was at least ten days prior to the Trustee's Sale held on March 23, 2010,
