APFEL and MARY ANN APFEL, Husband and Wife, GRANTORS, in ~'~ <br />consideration of the sum of Two Hundred Thousand and No/100 Dollars ($200,000.00), receipt ~~ <br />of acceptable obligation for installment payment is hereby acknowledged, conveys to DEREK J. `~ <br />APFEL and BONNIE J. APFEL, Husband and Wife, as joint tenants with right of survivorship <br />and not as tenants in common, GRANTEES, the following-described real estate (as defined in <br />Neb.Rev.Stat. 76-201) in Hall County, Nebraska: <br />Parcel 1: A tract of land 140 feet by 100 feet in size situate in the southeast <br />quarter of the northeast quarter (SE1/4NE1/4) of section Twenty-four (24), in <br />township twelve (12), North, range twelve (12), West of the Sixth P.M., more <br />particularly described as follows: Commencing at a point 100 feet south of <br />the intersection of the south line of Syria Street of the First Addition of the <br />Village of Cairo, as shown by the recorded plat thereof and the West line of <br />High Street, if extended south; running thence south a distance of 100 feet on <br />said West line of said High Street, if extended south; running thence West a <br />distance of 140 feet on a line parallel to the said south line of said Syria Street, to <br />the east line of the alley of BLOCK 4 of said First Addition, if extended south; <br />running thence North a distance of 100 feet on the East line of said alley, if <br />extended south; running thence east a distance of 140 Feet on a line parallel to said <br />south line of said Syria Street to the place of beginning; <br />and <br />Parcel 2: The westerly Ten (10) Feet of Lot Five (5) and all of Lot Six (6), in <br />Block "F" in MacColl and Leflang's Second Addition to the Village, now City, of <br />Wood River, Hall County, Nebraska, as surveyed, platted and recorded, and the <br />unplatted tract of land lying between Lot Six (6), Block "F'" in MacColl and <br />Leflang's Second Addition and Lot One (1), Block Three (3) in Chamberlin's <br />Addition to the Village, now City, of Wood River, Hall County, Nebraska. <br />It is the intention of all parties hereto that, in the event of the death of either of the <br />Grantees, the entire fee simple title to the real estate shall vest in the surviving Grantees. <br />GRANTORS covenant with the GRANTEES that GRANTORS: <br />(1) are lawfully seised of such real estate and that it is free from encum- <br />brances; <br />(2) have legal power and lawful authority to convey the same; <br />(3) warrant and will defend the title to the real estate against the lawful <br />claims of all persons. <br />Executed this ~ day of rC.4~l_ ~, 2010. <br />:, <br />Ra and C.
