<br /> AFFIDAVIT OF CONTINUING LIEN
<br /> This Affidavit of Continuing Lien ("Affidavit") is made by the undersigned on behalf of Union Bank and
<br /> Trust Company ("Lender") pursuant to, without limitation, Nebraska Revised Statutes Sections 25-202
<br /> and 76-239. Being first duly sworn upon oath, the undersigned on behalf of Lender does hereby state as
<br /> follows:
<br /> 1) The Borrower(s) and/or the Grantor(s) named below remain indebted to Lender pursuant to
<br /> outstanding Promissory Note(s), including renewals, extensions, modifications, and replacements thereto
<br /> heretofore or hereafter executed.
<br /> 2) The obligations of Borrower(s) and/or of Grantor(s) to Lender for repayment of the Debt is secured by,
<br /> without limitation, the following described real estate, including without limitation all fixtures and
<br /> appurtenances and water rights thereto and all rents, profits, products, and proceeds thereof pursuant to
<br /> the Security Instrument defined below.
<br /> LEGAL DESCRIPTION: Lot Twelve (12) and the Easterly Sixteen and Eight Tenths feet (Ell 6.8') of
<br /> Lot Thirteen (13), Block "EE", Parkview Subdivision, located in the Northeast Quarter (NE1/4) of
<br /> Section Twenty Eight (28), Township Eleven (11) North, Range Nine (9) West of the 6", P.M., in the
<br /> City of Grand Island, Hall County, Nebraska.
<br />
<br /> 3) As of the date hereof, the Debt is unpaid and is owing to Lender, and the Security Instrument remains
<br /> a valid, subsisting and enforceable lien against the real estate.
<br />
<br /> 4) Pursuant to (without limitation) the above referenced Nebraska Statutes, the cause of action of Lender
<br /> and the record notice of the Security Instrument shall continue after the date hereof for the time periods
<br /> set forth in said Nebraska Statutes.
<br /> 5) As used herein, the following terms have the following meanings:

<br /> air Y77 a) Borrower means and includes the following (and if more than one, the term includes all such
<br /> persons/entities): PlumBest, Inc.,
<br /> Vernon Penas and Patricia Penas
<br /> d ` tz) Grantor means and includes the following (and if more than one, then includes all such
<br /> ; persons/entities): Plum Best, Inc.
<br /> c) Security Instrument means the following instrument and all renewals, extensions,
<br /> modifications, and replacements thereto, which such Security Instrument is dated April 22, 1999,
<br /> and filed on April 22, 1999 with the Register of Deeds of Hall County, Nebraska as Instrument
<br /> Number 99-104138.
