<br />and binding upon Tnastor and enforceable in accordance with its terms.
<br />35. Modifinations. This Deed of Truck may not be amended, modified or changed nor shall any waiver
<br />of any provision hereof be effective, except only by an instrument in writing and signed by the party against whom
<br />enforcement of any waiver, amendment, change, xrwdification or discharge is sought.
<br />36. Successors in, Interest. This Deed of Trust applies to, inures to the benefit of, and is binding not only
<br />on the parties hereto, but on their heirs, executors, administrators, successors and assigns. A11 obligations of Tractor
<br />hereunder are joint and several. The term "Beneficiary" shall mean the holder and owner, including pledgees, of the
<br />Note secured hereby, whether ar not named as 'Beneficiary herein.
<br />37, Severabiliiv_. If any term of this Deed of Trust or the application thereof to any person or
<br />circumstances, shall, to a~ extent, be invalid or unenforceable, the remainder of this Deed of Trust, or the application
<br />of such term to persons or circumstances other than those as to which it is invalid or unenforceable, shall not be affected
<br />thereby, and each term of this Deed of Trust shall be valid and enforceable to the fullest extent permitted by law.
