LESSEE shall maintain the said real estate and all improvE <br />reon and facilities appurtenant thereto in as clean and safe condition and repair as <br />SSEE takes possession thereof, ordinary wear and tear excepted; <br />8. Soil Conservation. If the said real estate or any portion thereof is now or during <br />rm of this FARM LEASE may become subject to a governmental soil conservation plan, t; <br />'ter execution of this FARM LEASE the said plan shall not be modified or filed except <br />utual written agreement of both LESSOR and LESSEE; <br />9. Water Allocation. If use of either groundwater or surface waters upon the said rep <br />is allocated, regulated or restricted by any means whatsoever, the LESSEE shall compl <br />~ith without incurring any penalty or additional restriction of the use thereof; <br />10. Encumbrances. LESSEE shall not allow or permit the imposition of any lien <br />encumbrance upon the said real estate or any improvement or alteration of the tapogral <br />.for improvements thereon without the prior written consent of LESSOR; <br />11. Access and Inspection. LESSOR ar agents or representatives thereof shall <br />fled to enter the premises at all reasonable times and to inspect the premises for the purls <br />determining compliance with the terms hereof and for all other lawful purposes consis <br />h the rights and interests of the LESSOR; <br />12. Costs and Expenses. LESSEE shall pay all casts and expenses incurred in the use <br />said real estate, including but not limited to the cost of seed, fertilizer, herbicides, pesticid <br />aicides, natural gas, propane gas, electricity and any other supplies ar utilities necessary <br />Ful for carrying out the purposes of this LEASE; <br />13. Assignn ent. LESSEE shall not sublease or assign this FARM LEASE or any ri <br />interest hereunder without prior written consent of LESSOR and any sublease or assignrn <br />violation hereof without prior written consent of LESSOR shall be void and shall be cause <br />urination hereof; <br />14. Indemnification. LESSEE and the successors and. assigns thereof shall indemn <br />l bald harmless LESSOR and its successors and assigns and the said real estate from any <br />claims and demands of any kind and nature arising out of the use and occupancy of LESS: <br />eunder except only for claims and demands arising from the sole and separate negligence <br />SSOR; <br />15. Insolvency.
