Peters, being first duly sworn, deposes and says: <br />1. That the Affiant is the successor trustee under the terms and conditions of the trust <br />instrument entitled the Luther F. Peters Trust dated November 4, 1981, and the trustee of the Luther <br />F. Peters Administration Trust created thereunder (hereinafter referred to as the "said Trust"). <br />2. That on June 20, 2009, the Affiant became the successor trustee and trustee ofthe said <br />Trust following the death of Luther F. Peters, also known as Luther Fredrick Peters, on June 4, 2009, <br />the settlor and initial trustee of said Trust, a certified copy of his death certificate is attached as <br />Exhibit "A", and upon signing an Acceptance to Act as Successor Trustee under the Luther F. Peters <br />Trust dated November 4, 1981, an original of which is attached as Exhibit "B". <br />That the Affiant remains the sole trustee of the said Trust as of this date. <br />4. That among the assets of the said Trust is the following described real property that <br />was transferred to the trustee under the trust instrument by Warranty Deed dated November 4, 1981, <br />and recorded in the Office of the Register of Deeds of Hall County, Nebraska, as document no. 81- <br />005763: <br />An undivided one-half (%z) interest in and to the East One-Half (E%z) of Lot <br />Eight (8) and all of Lot Nine (9), Block Twenty-one (2.1), in the Original Town <br />of Wood River, Hall County, Nebraska; <br />and by Warranty Deed dated November 4, 1981, and recorded in the Office of the Register of Deeds <br />of Hall County, Nebraska, as document no. 81-005764 : <br />An undivided one-half (~/z) interest iu and to Lots One (1), Two (2), Three (3) <br />and Four (4), Block Three (3) in the West North Lawn Second Addition to the <br />City of Wood River, Hall County, Nebraska, as surveyed; and <br />An undivided one-half (%z) interest in and to Lot Five (5), Block Twenty-six (26), <br />in the Village of Wood River, Hall County, Nebraska. <br />5, That pursuant to the terms of the said Trust and §30-2821(2) (g) of the Nebraska <br />Uniform Trust Code, the trustee of the said Trust has the power, without court authorization, to <br />acquire or dispose of an asset, for cash or on credit, at public or private sale. <br />6. That neither the said Trust or the Agreement creating the said Trust, nor any part <br />thereof, has been revoked or amended, and the above statements constitute a full disclosure of all <br />provisions concerning those items. <br />Dated: December 3t , 2009. <br />'LaVonne R.
