<br /> TRUSTEE'S DEED
<br />This instrument, made this 7~' day of January, 2010, between Eric H. Lindquist, a member
<br />of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor", pursuant to
<br />a power of sale contained in that certain Deed of Trust recorded on September 2, 2008 as Instrument
<br />No. 0200807572 in the office of the Register of Deeds of Hall County, Nebraska, and the Secretary
<br />of the Department of Veterans Affairs, hereinafter called "Grantee".
<br />WHEREAS, on October 21, 2009, Grantor, executed a Notice of Default pursuant to which
<br />notice was given to Tommy D. Harris and Tamara R. Harris, husband and wife, Trustors, under that
<br />certain Deed of Trust recorded on September 2, 2008 as Instrument No. 0200807572 in the office of
<br />the Register of Deeds of Hall County, Nebraska, covering that certain premises described as:
<br />Lots One (1), Twa (2), Three (3), Four (4), Five (5), Six (6), Seven (7) and Eight
<br />(8), all in Black One (1), in Clark's Addition to the Village, now City of Waod
<br />River, Hall County, Nebraska,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />Earth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, an October 26, 2009, as Instrument No. 0200908508.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. §76-1008.
<br />Subsequent thereto, beginning on November 27, 2009, Grantor caused to be published in
<br />The Grand Island Independent, a newspaper having a general circulation in Hall County, Nebraska,
<br />a Notice of Trustee's Sale setting forth a description of the property to be sold and stating that the
<br />described property would be sold at public auction to the highest bidder for cash or certified or
<br />cashier's check, at the lower level lobby of the Hall County Courthouse, 1st & Locust Street, Grand
<br />Island, Hall County, Nebraska at 2:00 p.m. on January 6, 2010. Publication of such notice was
<br />made for five consecutive weeks on November 27, 2009, December 4, 2009, December 11, 2009,
<br />December 1$, 2009 and December 24, 2009, the last publication being at least ten (10) days but not
<br />more than thirty (30) days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. §76-1008.
<br />Pursuant to said Notice of Trustee's Sale, Patrick A. Brock, attorney for Grantor, did at the
<br />time and place mentioned in said Notice of Trustee's Sale, offer said property for sale at public
<br />auction, and did sell the same to CitiMortgage, Inc, for the sum of $63,453.60, it being the highest
<br />bidder therefor. CitiMortgage, Inc. has assigned all of its right, title and interest in such bid to
<br />Grantee.
<br />NOW, THEREFORE, in consideration of the premises and of the sum of $63,453.60 so bid
<br />and paid as aforesaid, I, Grantor, do hereby grant and convey unto said Grantee, its successors and
<br />assigns forever, all the estate, right, title and interest of which the said Tommy D. Harris and
<br />Tamara R. Harris, husband and wife, and their successors in interest, were seized or possessed at the
<br />time said Deed of Trust was given, ar at any time thereafter, in and to the premises sold as aforesaid,
<br />to-wit:
