Shafer and Marcey A. Shafer (collectively <br />referred to as "Trustor") and the Geneva State Bank ("Beneficiary") <br />RECITALS <br />WHEREAS, Joel B. Shafer, then a single person, executed and delivered to <br />Beneficiary a Deed of Trust dated December 21, 2005 and recorded with the <br />Register of Deeds of Hall County, Nebraska on December 23, 2005 as Instrument <br />#200512548 that encumbers the following described real property: <br />All of Block Five (5), Ponderosa Lake Estates Subdivision in the City <br />...~ _ of Grand Island, Hall County, Nebraska (the "Shafer Residence"); and <br />WHEREAS, the Joel B. Shafer has executed and delivered to Beneficiary a <br />promissory note of even date in the original principal amount of $45,000 (the <br />"$45,000 Note") that will be secured by the Deed of Trust; <br />WHEREAS, the parties hereto enter into this Agreement to modify the Deed <br />of Trust to provide that the X45,000 Note is secured by the Deed of Trust. <br />NOW THEREFORE, in consideration of the extensions of credit made by <br />Beneficiary to Joel B. Shafer and the mutual promises and covenants set forth <br />herein, the parties hereto agree as follows: <br />1. Obli s e b the D ed of r s . The parties hereto <br />acknowledge and agree that the Deed of Trust secures and shall secure all sums <br />now or hereafter owing to Beneficiary by Trustor, or either of them under the <br />fallowing described promissory notes: <br />a. Promissory Note dated December 21, 2005 in the original principal <br />amount of $430,000 (Loan # 126067); and <br />b. The $45,000 Note. <br />2, Ratification and Consent. Trustor hereby ratifies, confirms, and <br />approves the execution and delivery of this Deed of Trust Modification Agreement, <br />1124801.1 <br />
