Shafer and Marcey A. Shafer (collectively referred to as "Trustor") and the Geneva State Bank ("Beneficiary") RECITALS WHEREAS, Joel B. Shafer, then a single person, executed and delivered to Beneficiary a Deed of Trust dated December 21, 2005 and recorded with the Register of Deeds of Hall County, Nebraska on December 23, 2005 as Instrument #200512548 that encumbers the following described real property: All of Block Five (5), Ponderosa Lake Estates Subdivision in the City ...~ _ of Grand Island, Hall County, Nebraska (the "Shafer Residence"); and WHEREAS, the Joel B. Shafer has executed and delivered to Beneficiary a promissory note of even date in the original principal amount of $45,000 (the "$45,000 Note") that will be secured by the Deed of Trust; WHEREAS, the parties hereto enter into this Agreement to modify the Deed of Trust to provide that the X45,000 Note is secured by the Deed of Trust. NOW THEREFORE, in consideration of the extensions of credit made by Beneficiary to Joel B. Shafer and the mutual promises and covenants set forth herein, the parties hereto agree as follows: 1. The parties hereto acknowledge and agree that the Deed of Trust secures and shall secure all sums now or hereafter owing to Beneficiary by Trustor, or either of them under the fallowing described promissory notes: a. Promissory Note dated December 21, 2005 in the original principal amount of $430,000 (Loan # 126067); and b. The $45,000 Note. 2, Ratification and Consent. Trustor hereby ratifies, confirms, and approves the execution and delivery of this Deed of Trust Modification Agreement, 1124801.1
