<br /> <br />t <br />ORDINP.NCE NO. 5775 <br />An ordinance creating Street Improvement District No. 1017; defining the boundaries <br />of the district; providing for the improvement of a street within the district by paving, <br />guttering, and a1I incidental work in connect therewith; and providing the effective date of <br />this ordinance. <br />BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA: <br />SECTION 1. Street improvert.~nt District No. 1017 in the City of Crand Island, Nebraska, <br />is hereby created. <br />SECTION Z. The boundaries of the district shall be as follows: <br />Begirming at a point along the northern boundary of McShannon Subdivision, <br />said point also being the Northwest corner of Lot 4, McShannon Subdivision, <br />in the Northeast Quarter of the Northwest Quarter (NE}NW'2) of Section 22, Township <br />Eleven (11) North, Range Nine t9) West of the 6th P.M.; thence easterly along <br />the northerly boundary of McShannon Subdivision for a distance of 322.14 feet, <br />more or less; thence deflecting right along the westerly boundary of Block <br />_ 1, Seim Subdivision, fora distance of 19.1 feet; thence deflecting Lef[ along <br />the southerly boundary of Block 1, Seim Subdivision, for a distance of 124 <br />feet; thence deflecting right along the eastern boundary of McShannon Subdivision <br />for a distance of 767 feet; thence deflecting right along Che southernboundary <br />of McShannon Subdivision for a distance of 445.5 feet; thence deflecting right <br />along the western boundary of McShannon Subdivision for a distance of 109 feet; <br />thence deflecting Left 199 feet from and parallel to the southerly right-of- <br />way Line of Phoenix Avenue for a distance of 101.3 feet; thence deflecting <br />right along the easterly right-of-way line of Vine Street for a distance of <br />199 feet to the southerly right-of-way line of Phoenix Avenue; thence deflecting <br />left for a distance of 80 feet [o where the westerly right-of-way line of Vine <br />Street intersects with the southerly right-of-way line of Phoenix 4venue; thence <br />deflecting right 60 feet to where the westerly right-of-way line of Vine Street <br />intersects with the northerly right-of-way line of Phoenix Avenue; thence deflect- <br />ing right for a distance of 80 feet to where the easterly right-oF-way line <br />of Vine Street intersects with the northerly rightof-way Line of Phoenix Avenue; <br />thence deflecting left along the easterly right-of-way Line of Vine Street <br />for a distance of 295.5 feet; thence deflecting right 295.5 feet from and parallel <br />to the northerly right-of-way line of Phoenix Street for a distance of 100 <br />feet; thence deflecting left along the western boundary of McShannon Subdivision <br />for a distance of 122.6 feet to the point of beginning, all as shown on Che <br />plat marked Exhibit "A" attached hereto and incorporated herein by reference. <br />SECTION 3. The following street in the district shall be improved by paving, curbing, <br />guttering, and all incidental work in connection therewith: <br />_ Phoenix Avenue from Vine Street to Phoenix Circle and Phoenix Court; Phoenix Circle <br />and Phoenix Court. <br />Said improvements shall be made in accardance with plans and specifications prepared <br />by the Engineer for the City and approved by the Mayor and Council. <br />SECTION 4. The improvements shall be made at public cost, but the cost thereof, <br />excluding intersections, shall be assessed upon the lots and lands in the district specially <br />benefited thereby, as provided by law. <br />SECTION 5. This ordinance shall be in force and take effect from and after its <br />passage, approval, and publication, without the plat, as provided by Law. <br />SECTION 6.
