~~ <br />2A4 <br />81- i~~~~E~4':.' <br />for the execution of ~"per documents and agreements <br />necessary or advisable i~.i connection iwth the issuance of <br />the Bonds and for the issuance of Bonds. <br />"Cost", as applied to the Project or to any Additional <br />Improvemencs, shall embrace, without intending thereby to <br />limit or restrict any proper definition of such term under <br />the provisions of the Act, all costs of acquisition and <br />construction and all obligations and expenses and all items <br />of cost which are set forth in Section 403 of this <br />Indenture. <br />"Daily Newspaper'' shall mean a newspaper regularly <br />published in the English language at least five business <br />days in each calendar week. <br />"Excluded Property" shall mean all property other than <br />the Existing Property, the Building and the Leased Equipment <br />as defined herein and any anc9 all other property or interest <br />therein, whether real or personal or tangible or intangible, <br />which has been acquired by the Issuer out of funds other <br />than those represented by the proceeds from the sale of the <br />Bonds, and any products, proceeds, replacements, renewals or <br />substitutions therefrom. <br />"Existing Property" shall mean all that certain real <br />graperty situated in Hall County, Nebraska, subject to and <br />described in the Ground Lease, attached hereto as <br />"Exhibit A" and made a part hereof. <br />"Fiscal Year", except as otherwise provided in this <br />Indenture, shall mean the period commencing on the first day <br />of January of any year and ending on the last day of <br />December of that same year; or such other dates as the <br />company shall adopt for financial statement purposes. <br />"Governing Body° shall mean the Board of Supervisors of <br />The County of Hall, Nebraska, being the Governing Body of <br />the County. <br />"Government Qbligataone" shall mean obligations of, or <br />obligations the principal of and the interest on which are <br />unconditionally guaranteed by, the United States of Ameriea. <br />'"Ground Lease" shall mean the lease dated August 21, <br />1981 between the Railroad and the Sublessee providing fox <br />the leasing of the Existing Property by the Railroad to the <br />Sublessee. <br />"Ground 5ublease° shall mean the sublease dated as of <br />November 15, 1981 from the Issuer to the Company and from <br />the Comgany to the Sublessee subleasing the Existing <br />Progerty. <br />"Guarantor" shall mean collectively each of the <br />entities that have executed, as guarantors, the Guaranty, as <br />defined herein. <br />1'3 <br />t.._. <br /> <br />i <br />~..._ <br />
