t"~ <br />$1-- i~~5~9~! <br />plat of said UNiT FOUR, LdT 2, BLOCK 8 RrtLAT, CGNTINENTAL GARDENS, <br />the Subdivider hereby cansents and agrees with the City of Grand <br />Island, Nebrlska, that it will install or provide at its expense <br />the following improvements: <br />1. Water. The property located within the subdivision may <br />be connected to the City water main located in Capital Avenue adja- <br />cent to the subdivision with na connection fee. <br />2. Sanitary Sewer. The Subdivider agrees to canstruct the <br />sanitary sewer to serve the subdivision according to the plans and <br />specifications approved by the City's director of public works and <br />subject to the City's inspection. ALI structures located within <br />the subdivision must be connected to said sanitary sewer before <br />the Subdivider will apply for an occupancy permit for any such struc- <br />tures. There will be no connection fee. <br />3. The Subdivider agrees to grade the subdivision in accord- <br />ance with the plans and specifications approved by the City's direct- <br />or of public works which shall provide for storm drainage in such <br />a manner so that storm water flow drains to the detention cell locat- <br />ed at the intersection of Capital Avenue and Webb Road. <br />4. Sidewalks. The Subdivider, if still the owner of the <br />land in the proposed subdivision, or if the Subdivider shall have <br />transferred title to the property, then the various grantees there- <br />of, will install, at their owr. expense, all public sidewalks as <br />required by the Grand Island City Code when the adjacent lot is <br />hunt upon, and sidewalks shall be regulated and required with the <br />building permit for each such lot. These sidewalks will be install- <br />ed only when deemed necessary by the City of Grand Island. <br />5. Warranty. The undersigned owner, as Subdivider, warrants <br />that it is the owner in fee simple of the land described and pro- <br />posed to be known as Unit Four, Lot 2, Block 8 Replat, Continental <br />Gardens, and that an abstract of title will be submitted foe examin- <br />ation, if necessary, upon request of the City of Grand Island. <br />6. This agreement shall run with the land and shall be binding <br />upon and inure to the benefit of the parties hereto, their success- <br />oxs, assigns, heirs, devisees, and legatees.
