<br />Form 43 <br />GAS UTILITY EASElSENC <br />L3I-- i)l1 7 ~_3v <br />K3i0M ALL ?~tI BY THESE PRESENTS: <br />That N2ado'ia' '' °°*°}~~ TT'Y' _- -, Grantor, of <br />the County of Ball _, the State of Nebraska for and in considera- <br />tion of the sum of One Dollar ($1.00} and other good and valuable consideration, the <br />receipt of which is hereby acknowledged, do_ hereby grant, remise, convey, and relin- <br />quish unto Northwestern Public Service Company, Crantee, a Corporation, Huron, South <br />Dakota, its sucussors or assigns, a utility easement, for the installation, maintenance <br />and operations of gas lines, and appurtenances thereto, over, under, upon and through <br />the following deshribed lands situated in the County of Hall _, the State of <br />Nebraska- , to wit: <br />A tract of land Sixteen t1b.0) feet in width comprising a part of Lot <br />Twelve (12), Meadowlark Estates Subdivision, Hall County, Nebraska, the <br />centerline of which is more particularly described as follows; <br />F,F <br />Beginning at a point on the west line of said Lot Twelve (12), also <br />being the easterly right-of-way line of the Union Pacific Railroad, <br />said point being Three Hundred Seven and One Tenth (307.1) feet north <br />of the southwest corner of said Lot Twelve (12); thence easterly -- <br />perpendicular to the west line of said Lot Twelve (12), a distance of <br />Eight (8.O) feet; thence northerly parallel to the west line of said <br />Lot Twelve (12), a distance of One Hundred Ten (110.0) feet; thence <br />easterly perpendicular to the west line of said Lot Twleve (12.), a <br />distance of Ninety Eight and Twenty Five Hundredths (98.25) feet to <br />a point on the west line of Lot Ore (1), Meadowlark Estates Subdivision, <br />said point being One-Hundred Forty Two and "Iinety Four Hundredths <br />(742.94} fee-t south of the northwest corner of said Lot One (1). <br />TO NAVE A41D TO HOLD unto said NORTHHESTERN PUBLLC SERVICE COl~ANY, its successors <br />antk assigns, sa long as such utility lines and appurtenances thereto shall be maintained <br />and operated, together with the right of ingress and egress from said premises for the <br />purpose of constructing, installing,- inspecting, repairing, maintaining, renewing and <br />replaci~ the property of the grantee located thereon, or removed thereof, in whole or <br />in part, at the will of the grant=e. <br />Tfie Grantor further oovenants for themselves, their heirs, lessees, successors, <br />or assigns that the Grantee, its Lessees, successors or assigns shall at all times have <br />the-right to cut and remove or trim all trees, bushes and saplings growing upon said <br />lands above described, or extending over same, so far as may De reasonably necessary <br />for the construction, reconstruction, operation,- repair, and maintenance of gas lines, <br />and shall have the right of access and entry to and upon said above described lands for <br />ouch purposes. <br />Grantor reserves to themselves the right to cultivate, use and occupy the above <br />daacriLad lands provided such use and occupancy is not inconsistent with the rights <br />granted by this easement. <br />This.aasement sad the rights granted and conveyed hereunder shall run with the <br />Ianda above deacriDad-and shall inure to the benefit of and be binding on the heirs, <br />lessees, euccesaors os assigns of the respective parties hereto. <br />Ds;ted this ?th day af_ _ • <br />
