Form FmNA-NE 443-3 <br />(Rev. 1-9-76) <br />82-u04645 1 <br />AGREEMENT WITH REAL ESTATE CONTRACT SELLERS AND BUYERS ~ <br />WHEREAS, Dorothy LepP and Wilbur Let}P <br />husband and wife, (hereinafter called "sellers"~ have sold to <br />_ a~ Alvin Denman <br />(hereinafter called "buyers"), under the terms of a certain real estate <br />installment contract, the following described property situated in the <br />State of Nebraska, County of Hall to wit: <br />An Undivided one-Half (~) Interest in Lots One (1) and Two (2),'Section <br />Thirty--0ne (31), Township Ten (10) North, Range Ten (10), West of the <br />5th P.M., Hall County, Nebraska, <br />for the sum of Fnrty-Two Thousand Dollars ($42,000.00)------ said agreement <br />being dated, executed and acknowledged on November 6 1978 and <br />WHEREAS, the buyers propose to obtain a loan in an amount not to exceed <br />One Hundred Thousand Dollars ($ 100.000.00 ) from <br />the United States of America, acting through the Farmers Home Administration, <br />United States Department of Agriculture, and which property will be mortgaged <br />to the Government to the extent of the buyers' interest as security in <br />connection with said loan, <br />NOW, THEREFORE, in consideration of the foregoing, the sellers or <br />their representatives, agree that they will comply with the terms of said <br />contract except as modified hereby and that in the event of default on the <br />part of buyers under said contract, sellers will judicially foreclose the <br />same. and seek deficiency judgment if necessary, and will forego any other <br />remedy accorded to them by said contract or by law. The sellers or their <br />representatives, give their consent to the buyers to mortgage the buyers' <br />interest under the above-mentioned real estate contract.
