Philippi and <br />Fred M. Janisch, hereinafter referred to as the "Assignees," <br />WHEREAS, it has become necessary to clarify certain portions <br />of the Contract,For Sale of Real Estate executed by the Seller <br />and the Buyer in regard to property legally described as: <br />A tract of land comprising a part of the Northeast <br />Quarter (NEB) of Section Twenty-Four (24}, Township <br />Eleven (11) North Range Ten (10), West of the 6th P.M. <br />in Hali County, Nebraska, more particularly described <br />as €ollows: Beginning at the center of said Section <br />Twenty-Four (24); thence northerly along and upon the <br />west line of said Northeast Quarter (NE's) a distance <br />of Seven Hundred Fifteen and Eight Tenths (715.8) feet, <br />to a point on the southerly right-of-way line of U.S. <br />Highway No. 30; thence deflecting right 60°33' and <br />running northeasterly along and upon said right-of-way <br />line, a distance of Thirty-Seven and Nine Tenths (37.9) <br />feet to the actual place of beginning; thence contin- <br />uing northeasterly along and upon said right-of-way <br />line, a distance of Two Hundred Eighty-Seven and Eight <br />Hundredths (287.08) feet; thence deflecting right 90°00' <br />and running southeasterly a distance of Two Hundred <br />(200.0) feet; thence deflecting right 90°00' and running <br />southwesterly a distance of Four Hundred (400.0) feet to <br />a point Thirty-Three {33.0) feet east of the west line <br />of said Northeast Quarter (NE~t}; thence northerly paral- <br />lel to said west line of the Northeast Quarter {NEB); a <br />distance of Two Hundred Twenty-Nine and Sixty-Eight <br />Hundredths (229.68) feet to the actual place of beginning <br />and containing 1.577 acres, more or less, subject to <br />channel eas~sent situated in the northwest corner of <br />described property; and <br />WHEREAS, the Seller wishes tc, a~:sign this Contract For Sale <br />of Real Estate in its entirety; <br />IT ~S, TH::RE!'(1R:;, A;;L"':;: <br />1. Buyer hereby consents to assignment of the Contract For <br />Sale of Real Estate from Seller to Assignees. <br />2. Assignees shall assume all of thy: 5eller's rights and <br />obligations under the contract referred to by this Addendum. <br />3. Buyer specifically acknowledges that it is purchasing <br />this property subject to a mortgages of Commercial Savings Company <br />of Grand Island, Nebraska.
