.._. <br />,r-- ~ ~.. ll l1 t7 / O <br />_i . <br />AGREEMENT----------------°----------------------------------Page Three <br />become due, Seller may pay said taxes, and the amount so paid shall be° <br />come due and payable forthwith by Buyers to Seller without notice or <br />demand and shall become a part of the principal balance due under this <br />agreement. <br />If the Buyers fail to pay any amount due under the terms of this <br />agreement or if Buyers fail to perform any of the other terms, covenants <br />or conditions of this agreement, or if Buyers shall abandon tl:e real <br />estate, the whole of the indebtedness under this agreement., together <br />with any advances made by Seller as herein provided, shall 6ecom~+and <br />be immediately due and payable at the option of the Seller without notice <br />or demand, the same being expressly waived, and Seller may proceed to <br />foreclose this contract in the manner provided by law. <br />Failure of Seller to exercise any optional remedy hereby speci- <br />fied at the time of any default shall not operate as a waiver or the <br />right of Seller to exercise such optional remedy for the same or any <br />subsequent default at any time thereafter. <br />VI. <br />Covenants of Seller <br />Upon payment by Buyers of the purchase price in full, together <br />with all interest thereon, and the performance by Buyers of all cove- <br />nants and conditons which, by the terms of this agreement, are to be <br />performed by Buyers, Seller agrees and covenants to convey the real <br />estate to Buyers by deed of general warranty, subject, however, to <br />alI conditions, easement, restrictions, and limitations of record, to <br />the rights of persons in possession, to the lien of all unpaid taxes <br />and assessments for public improvements, and to any other encumbrances <br />which, by the terms of this agreement, are to be paid by Buyers. <br />VYI, <br />Escrow <br />It is agreed that Seller shall sign a deed as of the date of this <br />contract to Buyers and shall deliver the same, together with a copy of <br />this agreement, in escrow to Fitzgerald, Brown and Dunmire, Hastings, <br />Nebraska, for delivery to the Buyers when proof is furnished that the <br />
