<br />of Grand Island, Nebraska in consideration of the advance of
<br />the principal sum decided in the note hereinafter described and iri con-°
<br />sideration of future advances of funds siade by assignee to assignors or
<br />any of them as hereinafter provided, hereby assigns and conveys to COMAG
<br />Credit Cora whose
<br />principal office is at 424 West Third Street, Grand Island, Nebraska ,
<br />all their rights, titles and interest in a contract to purchase real
<br />estate dated March 14, 1971 by and between Don S. Mertz Company,
<br />A Nebraska Corporation __ seller, and Harold W. Harrington
<br />purchasers, the following described
<br />real estate:
<br />Northeast Quarter (NE~a) of Section Thirty-fcur (34) in Township Twelve (12)
<br />North Range Eleven (11) West of the 6th P.M. in Hall County, Nebraska.
<br />containing 160 acres, more or less, according to Government survey;
<br />toge[her with all of the right, title and interest of the Assignors in
<br />said property now owned, or hereafter acquired, and including all build-
<br />ings and improvements now on or hereafter placed upon, said real property;
<br />including also all water, and drainage rights.
<br />This assignment is given to secure:
<br />(a), A promissory note dated April 15, 1981 , given by Assignors
<br />to Assignee in the principal sum of Four Hundred Forty Thousand
<br />and no/100 --------------------dollars, payable with interest ac-
<br />cording to the terms of said note and any instruments taken in re-
<br />financing, extending, or renewing said indebtedness or any part
<br />thereof;
<br />(b) Any future advance{s), with interest, which may be made from
<br />time to time by Assignee, at its option, to Assignors, or any of
<br />them or their successors in title, for any purpose in any amount or
<br />amounts, provided, however, that such future and additional advance(s3
<br />shall be so limi*_ed that the total principal amounts outstanding at
<br />any time shall not exceed the sum of Four Hundred Seventy Five Thousand
<br />and no/lOC ------------------dollars, and provided further the future
<br />advance(s) so made shall be payable in accordance with the terms of a
<br />promissory note or notes which may be taken to evidence such advance(s)
<br />or any part thereof. (The optional advance(s) herein authorized shall
<br />be considered additional to the advance(s) hereinafter authorized
<br />to be made by the Assignee for the protection of the security or
<br />Assignee's interest therein).
<br />This assignment to be void upon the payment in full with interest of any
<br />obligations, present or future, secured or to be secured hereby.
