This Contract may E>e assigned by the Buyer~_ <br />upon the written coflsent of the Sellers, and Buyer agrees not to abandon or <br />sublet said property or any part thereof. <br />l0. E)efault and Heimedies. If the Buyer falls to make any pay~ent <br />due hereunder, or to perform any of the terms of this Contract as required <br />of thdm, for a period of 34 days, after the same is due, or to be performed, then <br />the Sellers shall have the option of declaring a farfeiture of and of de- <br />claring the entire unpaid balance imrtediately due and payable. In addfition, <br />the Sellers shall be entitled upon default of Buyer to foreclose said <br />Contract, as provided by law. <br />Buyer agrees to execute and place in escrow a Quitclaim C3eed to <br />Sellers of her interest in said property with instructions Lo the Escrow agent <br />that said Deed 1s to be delivered to the Sellers upon default of Buyer as <br />provided in this paragraph. <br />12. Waiver. Any waiver by the Sellers of the time or manner of <br />payeent due hereunder, or-time or manner of performance of arts required <br />here~.-:~er by tt',e Buyer upon one occasion, shall not constitute waiver or <br />relinquis#mment of any right by Sellers to demand subsequent payments when <br />due or t4 deprand perfor+sance by Buyer in accardance with the terms of this <br />Agreemxs-t on any or other subsequent occasions. <br />12. Bindinq_Effett. This Contract is binding upon the heirs, <br />devisers, personal representatives and assigns of the parties hereto, and the <br />parties agree that time is of the essence, and for the faithful performwnce <br />of the- termtt of this Contract. The parties agree to execute a t4otice of <br />Contract of Sale concerning this installment sale contract, which may <br />be recorded by either party hereto. <br />l3. Conveyance and Marketable Title. Sellers agree to furnish <br />the BMyars with a current extended Abstract of Title showing themt to be the <br />owners of a good and sufffcient marketable title to the above property, <br />free and clear of liens. Sellers agree to convey the above property by Mtarranty <br />Deed and to pay for the expense of documentary sta~.+s and the Sellers will <br />pair for the rxteasion of an Abstract of Title, extended to doer, showing marketable <br />title, aad in the Brant Ghat title examination reveals any valid title <br />ob;~ectioas, the Sellers shall have a reasonable times to correct such defects <br />amad is the ereflt the sao~a cannot be corrected, all payments e~ hereunder steall <br />be refueufed to the Buyer, The Buyer has the option of waiving any defect in <br />
