81--t1ft2463 AGREEMENT This Agreement is made and entered into this ~.~ day of May, 1481, by and between National Bank of Commerce Trust and Savings- -- Association, Lincoln, Nebraska (hereinafter "NBC"} and Nehza ka Mii-Nic, Inc. (hereinafter "Mil-Nic"1. WfiEREAS, Lawrence E. xuwaldt has executed and delivered, on behalf of Mil-Nic, a promissory note in the principal amount of $750,000 dated April 30, 1981, and secured the same by a real estate mortgage relating to the real pzoperty described in Exhibit A atta~hed- hereto and incorporated herein by this reference; and S+IHEREAS, said real estate mortgage recites that the National Bank- of Commerce Trust and Savings Association is the "Mortgagor" and that- Nebraska Mil-Nic, Znc. is the "Mortgagee"; and WHEREAS, this recitation is in error and the true and correct Mt?rtgagOr is Nebraska Mil-Nic, Znc. and the true and correct Mortgagee is National Bank of Commerce Trust and Savings Association; *IQW, TxEREF4RE, the parties agree as follows: i. Nebzaska Mil-~~ic, Znc. will execute and deliver a real estate mortgage relating to the yroperty described in Exhibit A to National Bank of Commerce .'rust and Savings Association. 2, Said rortaage shall he in substitution for that certain real estate mortgage reiatin-+ to the :cal aroperty described in Exhibit A dated April 30, 1981, and recorded May ~, 1981, as Document #81-002274 in the Mortgage Records of Hall County, Nebraska. 3. Said mortgage shall be given to correct a scrivener's error with respect to the mortgage previously 5iven and recorded as Bocuusent ti81-002279 in the Mortgage Records of Hall County, Nebraska, anti shall secure the promissory note dated April 30, 1981, wherein *til-tdic is the maker and "IBC is the payee.
