<br />MEMORANDGM OF LAND SALE CdNTRACT <br />THIS MEMdRANDUM dF LAND SALE CdNTRACT made and entered into <br />this 16 day of April , 1981, by and between RICHARD <br />S. CA`NEE and COLLEEN f3. CAVEPdEE, husband and wife, Sellers, <br />and GEidE T. SCHUMACHER and ANNA M. SCHUMACHER, husband and wife, <br />Buyers. <br />i1ITNESSETH <br />i+7HEREAS, Sellers are the owners of: <br />Lot Twenty-One (21), Block Two (2), Southern <br />Acres, Addition to .the City of Grand Island, <br />Hall County, Nebraska, <br />which property and its appurtenances Sellers are willing to sell <br />under certain installment sales contracts; and <br />WHEREAS, Buyers have aareed to purchase the property, both <br />real and personal, under a Land Sale Contract made and entered <br />into an April 16 1981, and <br />WHEREAS, the Land Sale Contract made and entered into of even <br />date herewith ,'provided that the parties hereto would execute a <br />Memorandum of Land Sale Contract contemporaneously with the exe- <br />cution of the Land Sale Contract for the purposes of recording, <br />Nltri, '1't1ERcr ~Rn, Ln ConSideraLlaii :.ai cite iTi lit iidi ~ii-Umise~ U~ <br />each of the parties hereto, the follnwiny are summarized provisions <br />of the Land Sale Contract of even date herewith included for re- <br />recordina purposes: <br />1. Sellars agree to sell and convey snto Buyers and Buyers <br />agree to purchase from Sellers *_he following described real estate <br />and its appurtenances thereto: <br />Lot Twenty-C7ne (21), Black Two (2), Southern <br />Acres, Additior, to the City of Grand Island, <br />Hall County, Nebraska. <br />2. Buye rS agree to say to :Se ile ra fc"Sr the abGVc deSCrlbed <br />property the sum of Fifty-Six Thousand Twenty Five Dollars <br />(556,025.00) as provided in the Land Sale Contract, with the sum <br />of Twenty-Five Dollars ($7.5.00) to be paid on the date of the sign- <br />ing of the agreement and the balance of Fifty-Six Thousand Dollars <br />($;6,000.00) to be paid in monthly installments of Five Hundred <br />Ninety-Seven Dollars Sixty-Seven Cents (5597.67) per month, amortized <br />over a period of theirty (30) days, which monthly payments includes <br />principal and interest at the rate of Twelve and One-Ha1f~Percent <br />(i2~8) per annum, with the first monthly payment to be paid on <br />the first day of the month following the date of the signing of <br />the Contract and an identical amount on the first day of each <br />and every month thereafter. <br />That in addition to the payment of principal and interest as <br />set forth above, Buyers shall pay to Esorow Agent the real estate <br />taxes for every year the Contract is in existence and insurance <br />premiums for fire and extended coverage insurance on the property <br />in the amount of such premiums in any one year. The payment far <br />the real estate taxes and insurance shall beprorated over twelve <br />{12) months of each contract year, with one-twelfth of the amount <br />to be paid into Escrow Agent each month. <br />3. The cost of revenue stamps for recording the Warranty <br />uses shall be witii~eld by Buyers from the last payment_on this <br />Contrast. <br />
