MOLLS and BONNIE L. <br />MOLLS, husband and wife, of Grand Island, Nebraska, hereinafter <br />re€er-recl to as the LICENSEES. <br />WITNESSETHc_ <br />WHEREAS, the Licensees are the owners of Lot Six (6}, Block <br />Thirty (30~, in Russel Wheeler's Addition to-the City of Grand <br />Island; Hall County, Nebraska; and <br />WHEREAS, a recent Land survey has determined Chat the garage <br />building and driveway encroach upon the public alley in the aforesaid <br />Block Thirty (30T. <br />NDW, THEREFORE, in consideration of the mututal covenants `aerein <br />contained, the parties agree as follows: <br />1. The City hereby-grants a license to the Licensees to maintain <br />the aforesaid prPSentiy situated garage building and driveway in <br />the public alley in Block Thirty (30), Kussel Wheeler's Addition, <br />contiguous to Lot Six (fr) thereof, not to extend more than l.b feet <br />into said right-of.-way, for a total distance of 51.8 fee*_. <br />2. It is understood and agreed that the Licensees can maintain <br />said encroachment- in the public right-of-Hay at their own risk. IC <br />i$ frxrther under.~tood and agreed that should such garage building <br />attd/or driveway k~e altered in any way, or removed from the public <br />t3;ghn-of-way, thy.s license agreement shell ic~auediately become null <br />attd void. <br />3. The Licensees hereby waive any claim for damages against <br />the ~s.ty o€ Grand Island, its ofFicers, agents, and employees, and <br />f.~tdependent contractors for any damage or injury that may result to <br />s~:d structure being located in the City alley right-of-way. <br />4.
