The Subdivider agrees to construct any and all <br />necessary water mains to serve all lots within said subdivision in <br />aeeordanee with plans and specifications approved by the City's <br />Director of Public Works and subject to the Gity's inspection. The <br />Subdivider agrees to connect all structures within said subdivision <br />to City water service prior to the issuance of any occupancy permits. <br />~4. Drainage. The Subdivider agrees to grade all lots within <br />said subdivision in conjunction with the structures thereon in such <br />a manner that storm water drains, pursuant tc City approved drainage <br />plan, to the storm water detention cell constructed in Holiday Garden <br />Subdivision, such cell to be expanded by the Subdivider to meet speci- <br />fications established by the City's Director of Publie Works to supply <br />sufficient drainage capacity for a five-year storm and the drainage <br />associated with said subdivisions. <br />5. Zoning. The Subdivision lies in a Residential Development <br />Zone as established by Section 3E-27 of the Grand Island City Code. <br />'The Subdivider agrees to follow the provisions of Section 36-27 in <br />regard to the development of the area. <br />6. Warranty. The undersigned owner, as Subdivider, warrants <br />that he is the owner in fee simple of the Land described and proposed <br />to be known as Holiday Garden Second Subdivision, and that an abstract <br />of title will be submitted for examination, if necessary, upon request <br />of the City of Grand Island. <br />7. This agreement shall run with the land and shall be binding <br />upon and inure to the benefit of the parties hereto, their successors, <br />assigns, heirs, devisees, and legatees.
