The Subdivider agrees to construct any and all necessary water mains to serve all lots within said subdivision in aeeordanee with plans and specifications approved by the City's Director of Public Works and subject to the Gity's inspection. The Subdivider agrees to connect all structures within said subdivision to City water service prior to the issuance of any occupancy permits. ~4. Drainage. The Subdivider agrees to grade all lots within said subdivision in conjunction with the structures thereon in such a manner that storm water drains, pursuant tc City approved drainage plan, to the storm water detention cell constructed in Holiday Garden Subdivision, such cell to be expanded by the Subdivider to meet speci- fications established by the City's Director of Publie Works to supply sufficient drainage capacity for a five-year storm and the drainage associated with said subdivisions. 5. Zoning. The Subdivision lies in a Residential Development Zone as established by Section 3E-27 of the Grand Island City Code. 'The Subdivider agrees to follow the provisions of Section 36-27 in regard to the development of the area. 6. Warranty. The undersigned owner, as Subdivider, warrants that he is the owner in fee simple of the Land described and proposed to be known as Holiday Garden Second Subdivision, and that an abstract of title will be submitted for examination, if necessary, upon request of the City of Grand Island. 7. This agreement shall run with the land and shall be binding upon and inure to the benefit of the parties hereto, their successors, assigns, heirs, devisees, and legatees. Where the term "Subdivider" is used in this agreement, the subsequent owners of any lots in the subdivision shall be responsible to perform any of the conditions of. this agreement if tha Subdivider has not performed such conditions.
